HomeMy WebLinkAboutApprove a One-Year Preliminary Plat Extension for Baxter Meadows Subdivision.pdfReport compiled on December 8, 2010 REPORT TO: Honorable Mayor and City Commission FROM: Dave Skelton, Senior Planner Tim McHarg, Planning Director Chris Kukulski, City Manager SUBJECT: Baxter Meadows Major Subdivision, Phase 4 Request for One-Year Extension of Preliminary Plat Approval, #P-07011 MEETING DATE: Monday, December 20, 2010 AGENDA MEETING ITEM: CONSENT AGENDA ITEM RECOMMENDATION: That the City Commission approves the applicant’s request for a one-year extension of preliminary plat approval for Baxter Meadows Subdivision, Phase 4 to June 18, 2011 as recommended by the Development Review Committee. BACKGROUND: PC Development, represented by Mark Meissner of Baxter Meadows South, LLC, has requested a one-year extension of preliminary plat approval for Baxter Meadows Subdivision, Phase 4, Planning Application #P-07011. On June 18, 2007 the Bozeman City Commission granted conditional approval of Baxter Meadows Subdivision, Phase 4 a 126-lot residential major subdivision. Phase 4A was filed on December 20, 2007 and the applicant is now requesting the one-year extension of preliminary plat approval for Phase 4B, 4C and 4D in order to market and/or reposition the development of the major subdivision. Under Section 18.06.040.D.6 of the City of Bozeman Unified Development Ordinance, the City Commission may, at the request of the subdivider, extend its three-year preliminary plat approval for one (1) additional calendar year. The Development Review Committee considered the applicant’s request on October 6, 2010 and discussed the need to address the control of noxious weeds on the subject property with any approval for a one-year extension (see attached DRC memo and correspondence with Mark Meissner). Based on the information provided by Mr. Meissner and the applicant’s willingness to address the noxious weed matter, the DRC found that the granting of a one- year extension would not influence conditions of preliminary plat approval nor the primary criteria for consideration of subdivisions established in Title 76-3-608, M.C.A. As a result, the Planning Office and Development Review Committee recommend approval of said request for a one-year extension of preliminary plat approval. UNRESOLVED ISSUES: None determined at this time. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues, along with increased costs to deliver municipal services to the property, when the property is developed. That the applicant provide the Planning Office with documentation within ten (10) working days of approval by the Development Review Committee of a determination by the City Engineer’s Office and County Weed Control Office that the control of noxious weeds is being properly implemented as outlined in the approved Memorandum of Understanding for said major subdivision. 2. Should the City Engineer’s Office and/or County Weed Control Office determine that the control of noxious weeds is not being properly implemented the applicant shall financially guarantee the control of noxious weeds by a certified applicator for a minimum of two years prior to approval of the one-year preliminary plat extension. 3. Any specific recommendations by the City Engineer’s Office and County Weed Control Office to treat areas of noxious weeds shall be documented and submitted to the Planning Office within five (5) days of said application. 124 125 126 127 128 129
