on the Basis Of Disability
The City of Bozeman does not discriminate on the basis of
disability in the admission or access to. or treatment or
employment in, its programs or activities. The Assistant to
the Bozeman City Manager has been designated to coordinate
compliance with the non-discrimination requirements contained
in section 35.107 of the Department of Justice regulations.
Information concerning the Americans with Disabilities Act. and
the rights provided thereunder. are available from the ADA
coordinator.

Grievance Procedure
The Americans with Disabilities Act (ADA) provides comprehensive civil rights protection to
individuals with disabilities in the areas of employment. public accommodations. state and local
government services and programs. and telecommunications. Title II of the ADA states. in part,
that "no otherwise qualified disabled individual shall. solely by reason of such disability. be
excluded from the participation in. be denied the benefits of. or be subject to dIscrimination" in
programs or activities sponsored by a public entity.
The City of Bozeman has adopted this grievance procedure to provide prompt and equitable
resolution of complainants alleging any action prohibited by the U.S. Department of Justice
regulations implementing Title II of the ADA.
Any individual who believes that (s)he or a specific class of individuals with disabilities has
been subjected to unlawful discrimination on the basis of that disability by the City of Bozeman
may. by himself or herself or by any authorized representative. file a complaint.
Complaints should be addressed to The Assistant to the City Manager. City of Bozeman. P.O.
Box 640, Bozeman, MT 59715, (406) 586-3321, who has been designated to coordinate ADA compliance
efforts.
1. A complaint must be filed in writing and contain: the name and address of the individual or
representative filing the complaint. a description of the alleged discriminatory action in sufficient
detail to inform the entity of the nature and date of the alleged violation. and be signed by the
complainant or authorized representative. Complaints filed on behalf of third parties must
describe or identify the alleged victims of the discrimination.
2. The complaint must be filed within 180 days after the alleged violation occurs. The time may
be extended for good cause shown.
3. An investigation. as may be appropriate. shall follow filing of complaint. The investigation
shall be conducted by the Assistant to the City Manager. These rules contemplate informal but
thorough investigations. affording all interested persons and their representatives, if any. an
opportunity to submit evidence relevant to a complaint.
Under the Department of Justice regulations, the City of Bozeman need not process
complaints from applicants for employment.
4. A written determination as to the validity of the complaint and a description of the
resolution, if any. shall be issued by the Assistant to the City Manager and a copy forwarded to
the complainant no later than 30 days after its filing.
5. The complainant may request a reconsideration of the complaint in cases where (s)he is
dissatisfied with the resolution. The request for reconsideration must be made to the Bozeman City
Commission within 30 days of the original finding.
