WHEREAS, M.C.A. §10-1-604 provides that employees with six (6) or more months of
service to the City be given fifteen (15) working days of military leave of absence in a calendar year
for attending regular encampments, training cillises, and similar training programs of the Montana
National Guard or Armed Forces of the United States;
WHEREAS, M.C.A. §10-1-604 does not apply to the recent military mobilizations to serve in
the war against terror or operations;
WHEREAS, other cities in the State of Montana have expanded the interpretation to allow
the fifteen (15} working days in a calendar year to be used for mobilization of milit~u-y members
pursuant to Title 10 U.S.C. Section 12302 and Presidential Executive Order l 3223; and
WHEREAS, previous City Manager Clark Johnson had verbally directed that for employees
of the City of Bozeman who have been deployed to haq or have been, or will be mobilized pursuant
Title 10 U.S.C. Section 12302 and Presidential Executive Order 13223.
NOW, THEREFORE, employees of the City of Bozeman who have been employed for a
period of six (6) months shall be given a leave of absence with pay for a period of time not exceeding
fifteen (15) working days in a calendar day for attending regular encampments, training cruises, and
similar training programs of the Montana National Guard or the military forces of the united States,
and for service pursuant to Title 10 U.S.C. Section 12302 and Presidential Executive Order 13223.
This Administrative Order is made retroactive to January 1, 2003....
