RELEASE AND RErC'ONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 121 North Rouse Avenue, Bozeman, MT 59715, a
Municipal Corporation of the State of Montana hereinafter ( "GRANTOR ") and does hereby
release and reconvey a portion of the following described easement unto Douglas L. and Kathy
A. Hanson, 2501 Westridge Drive, Bozeman, Montana, and their heirs and assigns, as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a ten (10) foot wide utility easement
situated on Lot 11, Block 9, Figgins Addition, 41h Phase, City of Bozeman, Gallatin County,
Montana, adjacent to the southerly property line; and
WHEREAS the above utility easement was granted November 17, 1977, with the
recording of the plat for Figgins Addition, 41h Phase, at the Clerk and Recorder's Office of
Gallatin County, Montana; and
WHEREAS the construction of public and private utilities to serve the nearby properties
has been completed without having; to fully occupy said easement recorded on November 17,
1977; and
WHERAS the existing utility lines are contained within the southerly five (5) feet of the
aforementioned utility easement; and
WHEREAS the abandonment of the northerly five (5) feet of the aforementioned utility
easement recorded on November 17, 1977, will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Douglas L. and Kathy
A. Hanson, 2501 Westridge Drive, Bozeman, Montana, and their heirs and assigns those portions
of the casement located on the above described real property as set forth on Exhibit A attached
hereto together with any right, title, or interest that the Grantor may have in said easements as set
forth on Exhibit A attached hereto and incorporated herein by reference as though fully set forth
and described as follows: abandon the northerly five (5) feet of the existing ten (10) foot wide
- utili1y easement situated on Lot 11, Block 9, Figgms Addition, 4 1h Phase, City of Bozeman,
Gallatin Coupjy, Montana, adjacent to the southerly property line.
This reconveyance shall not affect the remainder of that easement dated November 17,
1977, of record in the Clerk and Recorder's office of Gallatin County, Montana.
