WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and or plans of the contract be made by resolution and
WHEREAS, it has become necessary in the prosecution
of the work to make alterations or
modifications to the specifications and or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
I Bozeman,
Montana, that the proposed modifications and or alterations to the contract between the City of Bozeman,
a municipal corporation, and Duneman Construction. Belgrade, Montana, as contained in Change Order
41, attached. hereto. be and the same are hereby approved; and the City Manager is hereby authorized and
directed to execute the contract change order for and on behalf of the City: and the City Clerk is
authorized and directed to attest such signature.

Item 4; Throughout Alignment "A" the Contractor encountered thickened concrete sidewalk over and above typical
installation standard of 6" thick for a sidewalk to allow vehicle access (City of Bozeman and Montana Public Works (MPW)
standards), The sidewalk removed averaged 8 inches thick thus slowing the process of sidewalk removal, and increasing
disposal costs. An 8"16" ratio is applied (or +33% volume increase), for a net cost of +$3.50 per square yard (SY) greater
than the $10.75 per SY bid to remove 6" thick concrete sidewalk, Net work cost = +$2,23650
Item 5: Contractor encountered a Qwes phone line (marked un plans) within the planned excavation limits running
longitudinally along Afignment "B" in front nf the Bozeman Daily Chronicle. The depth was much shallower than typical

SURETY CONSENT
The surety hereby consents to the aforementioned contract change order and agrees that its bond or bonds shall apply
and the extend to the contract as thereby modified or amended per this change order. The principal and the surety further
agree that on or after execution of this consent, the penalty of the applicable performance bonds or bonds is hereby
