SUBJECT: Award of bid to F.L. Dye for the replacement of the main pool
pump for the Bozeman Swim Center.

RECOMMENDATION: Authorize the City Manager to sign the award of bid to F.L Dye for
the replacement of the Main Pool Pump for the Bozeman Swim Center for $40,342.00.
BACKGROUND: This project was approved for funding in the FY11 CIP plan. The
main pool pump circulates the water through the filtration, heater, and sanitation systems.
Montana health code requires that public pool water be circulated 24 hours a day at a rate of one
pool volume exchange every six hours.
The Swim Center’s main pump malfunctioned in September of 2009. The aquatic staff met with
Ellison Electric, engineers from Morrison-Maierle and City staff, and the City Water Dept. at
that time to determine the best fix. The pump was temporarily repaired to get through the
remaining fiscal year. It was recommended that the pump be replaced as soon as possible.
The new pump system will be a high efficiency system. A Variable Frequency Drive (VFD) will
be installed to control the speed the pump runs, spinning only as fast as it needs to maintain the
necessary water flow rate, reducing the amount of electricity needed to keep the pool water
circulating.
New filter grids will be purchased by staff rather than being included in the construction bid. By
purchasing the filter grids without vendor mark up, we will save an estimated $5,500.
This bid award is for the construction element of the Main Pool Pump.

FISCAL EFFECTS: This project was one part of the approved Swim Center
Mechanical Improvements CIP item for FY 2011. The Aquatics Division was budgeted $204,000
for several Swim Center items, one of which is the Main Pool Pump.
This project was budgeted for $85,000, which was based on a 2 pump system. It was determined
during the engineering process, that there was not sufficient space in the mechanical room for 2
pumps and therefore the plans changed to a 1 pump system, which reduced the cost significantly
and still provides the circulation necessary.
Below is a chart which lists each separate project within this CIP item, and its current status.

Dear James:
I have reviewed the bids for the Swim Center Main Pump Replacement project for the City of
Bozeman. There were four competitive bids received for the project on November 9, 2010,
submitted by F.L. Dye, 4G Plumbing and Heating, Williams Plumbing and Heating, and Watco
Pools. Copies of each bidder’s bid documents are attached.
F.L. Dye was the apparent low bidder with a total project bid of $40,342.00; however, they did
not include an affirmation of non-discrimination or an acknowledgement that the eventual
contract will contain a provision prohibiting discrimination as requested by the Addendum #1
modified Section 00100, Invitation to Bid. The next lowest bidder is 4G Plumbing and Heating,
with a total bid amount of $40,996.00. 4G Plumbing and Heating did note that they had received
Addendum No. 1 on the appropriate space on the bid form and on the project manual cover, but
they did not include the addendum and the acknowledgement in their proposal packet. The next
highest bid was in the amount of $42,499.00 and was recived by Williams Plumbing and
Heating; the WPH bid did not include an affirmation of non-discrimination or an
acknowledgement that the eventual contract will contain a provision prohibiting discrimination.
The highest bid was submitted by Watco Pools and was in the amount of 55,734.00.
The Engineer’s Estimate of the project cost (without contingency) was $42,031.48. The lowest
bid amount (submitted by F.L. Dye) is 4.2% lower than the Engineer’s Estimate, and the next
highest bid (4G Plumbing and Heating) is 2.5% lower than the Engineer’s estimate. The bids
submitted by WPH and Watco Pools are 1.1% and 32.6% higher than the Engineer’s Estimate,
respectively. It is important to note that the total project costs given above do not include
contingency money for any unforeseen contract amendments. I recommend allotting 10% of the
lowest bid price to the project budget for contingency purposes ($4,034.00) in the event that the
contract is awarded.
I have contacted John (Jack) Schaffer at F.L. Dye (the apparent low bidder) and asked him if he
is confident in his bid amount. He responded that he is confident in his bid price and he is
prepared to enter into an agreement with the City of Bozeman to complete the work. As you
directed, I have also requested that he provide on letterhead his affirmation to comply with the
City of Bozeman’s non-discrimination policy and I have included that letter with the attached bid
documents. It appears that F.L. Dye does possess the qualifications to be a responsible and
qualified contractor for this project. If F.L. Dye’s bid is found to be acceptable and the funds are
available, it is my recommendation that the City of Bozeman award the contract for the Swim
Center Main Pump Replacement project to F.L. Dye in the amount of $40,342.00.

Please indicate to me as soon as possible if the award of this project is acceptable. I will then
have a Notice of Award prepared with the appropriate signatures such that it can be delivered to
F.L. Dye with the Agreement.
