HomeMy WebLinkAboutResolution 3583 Fees for Street Cut Fee schedule COMMISSION RESOLUTION NO. 3583 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ESTABLISHING FEES AND REQUIREMENTS FOR PERMITTING EXCAVATIONS IN PUBLIC RIGHTS-OF-WAY WITHIN THE CITY OF BOZEMAN. WHEREAS, on March 17, 2003, the City Commission of the City of Bozeman passed and adopted Ordinance No. 1591, which revises Section 12.12.030 of the Bozeman Municipal Code to allow for the assessment of fees for permitting excavations in public streets, and provides that such fees shall be established by Resolution; and WHEREAS, Ordinance No. 1591 requires any person requesting permission to excavate in any public street to be properly bonded and insured, and provides that the amount of bonding and insurance required of any person permitted to excavate a public street shall be established by Resolution. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That the City Commission of the City of Bozeman hereby adopts the "Street Cut Fee Schedule" as set forth in Exhibit "A," attached hereto and by this reference made a part hereof. Section 2 That the City Commission of the City of Bozeman hereby establishes the minimum requirements of bonding and insurance coverages required of any person permitted to excavate in a public street, as set forth in Exhibit "B," attached hereto and by this reference made a part hereof. SULLIVAN Clerk of the Commission ------ EXHIBIT CIA" STREET CUT FEE SCHEDULE All persons permitted to excavate or cut a paved public street or alley shall pay the following fees prior to approval of the street cut permit. Pavement degradation fees shall only be required for excavations in asphaltic concrete pavement; pavement degradation fees shall not be required for streets or alleys with Portland cement concrete surfaces or gravel surfaces. The pavement degradation fee shall be determined by the actual area of the excavation plus an additional three (3) feet around the excavation. Streets shall be considered "protected streets" for a period of five (5) years following initial construction, re-construction, or re-paving. In addition to the normal pavement degradation fee, a pavement degradation fee surcharge shall be required for any excavation in a protected street according to the following schedule. Seal-coating alone or similar maintenance treatments shall not make a street protected. Application Fee: $50.00 Pavement Degradation Fee: $0.45/square foot Pavement Degradation Fee Surcharges: Ace of Protected Street o - 1 year $2.70/square foot 1 - 2 years $2.25/square foot 2 - 3 years $1.80/square foot 3 - 4 years $1.35/square foot 4 - 5 years $0.90/square foot EXHIBIT "B" BONDING AND INSURANCE REQUIREMENTS Any person requesting permission to excavate in any public right-of-way shall be required to provide documentation of the following minimum bonding and insurance coverages: General Liabilitv Insurance. This insurance shall include coverage for collapse and underground (CU) hazard, explosions (X) coverage, and contractual liability. Coveraae Minimum Limits of Liability Commercial General Liability Each Occurrence: $1,000,000 General Aggregate Limit: $2,000,000 Products - Completed Oper- ations Aggregate Limit: $2,000,000 Personal & Advertising Injury: $1,000,000 Fire Damage (anyone fire): $ 50,000 Automobile Liabilitv Insurance. This insurance shall include coverage for owned, non-owned, and hired vehicles. Coverage Minimum Limits of Liabilitv Business Automobile Liability Combined Single Limit: $1,000,000 Worker's ComDensation Insurance. State: Statutory Federal: Statutory Employer's Liability: $ 500,000 The City of Bozeman shall be named as additional insured on all required insurance coverages. Street ODening Bonds. For each street cut permit, street opening bonds submitted on approved bond forms shall be provided in the amount of $5000 or 100% of the cost of the work, whichever is greater, as surety for satisfactory completion of the work contemplated and maintenance of the competed work. The bond shall be valid for a period of at least one year following acceptance of the restoration by the City.
