This Contract Amendment is entered into by and: between the City of Bozeman (the Grantee),
and the Montana Department of Commerce (the Department)
The Grantee and the Department mutually agree to amend Contract # MT-TSEP-CG- 1 0 -471
(the Contract), executed by them on August 26, 2009, as follows:
1. Section 21 of the Contract is amended to read:
Section 21. Insurance
(a) General Requirements for Cities and Towns. Grantee shall maintain and shall assure
that its representatives, assigns, and subcontractors maintain for the duration of the
Contract, at their own cost and expense, liability insurance against claims for injuries to
persons or damages to property which may arise from or in connection with the
performance of the duties and obligations in the Contract by Grantee, its agents,
employees, representatives, assigns, or subcontractors. This insurance shall cover such
claims as may be caused by any negligent act or omission. The State, its officers,
officials, employees, and volunteers are to be covered as additional insured's for all
claims arising out of the use of grant proceeds provided by the State of Montana.
(b) Primary Insurance. This paragraph is deleted,
(c)(d)(e) and (f) These remain the same.
2. All other provisions of the Contract remain in full force and effect.
