COMMISSION RESOLUTION NO. 3596
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, PROVIDING FOR THE ANNEXATION OF A CERTAIN TRACT
OF
LAND, HEREINAFTER DESCRIBED, TO THE CORPORATE LIMITS OF
THE CITY
OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE CITY
OF
BOZEMAN SO AS TO INCLUDE SAID TRACT.
WHEREAS, the City of Bozeman received a request for annexation
from ThinkTank Design
Group, Inc., on behalf of Norman Benjamin, owner of the tracts, requesting the City Commission to
extend the boundaries of the City of Bozeman so as to include certain contiguous tracts of land generally
located southeast of the intersection of Kagy Boulevard and Sourdough Road in the County of Gallatin,
State of Montana; and
WHEREAS, an annexation staff report has been prepared in
accordance with the Commission's
goals and pOlicies for annexation and was presented to the Commission on October 21,2002; and
WHEREAS, Commission Resolution No. 3538 was adopted by the
City Commission on August
19, 2002, declaring it to be the intent of the City of Bozeman to extend the boundaries of said City so as
to include said contiguous tract within the corporate limits of the City; and
WHEREAS, a public hearing on Commission Resolution No. 3538
was duly noticed and held
on October 21 , 2002; and
WHEREAS, nine neighboring property owners and nearby residents
spoke in opposition to said
annexation and four nearby residents spoke in favor of the annexation; and
WHEREAS, the City received a petition signed by 34 persons
opposing the annexation; and
WHEREAS, on October 21, 2002, the Commission authorized
and directed staff, upon
satisfaction by the applicant of the terms of approval, to prepare the necessary documents to proceed
with the annexation of this tract in accordance with Commission Resolution No. 3538; and
WHEREAS, the provision of available services, including,
but not limited to, rights-of-way,
easements, water rights or cash in lieu, waivers of protest against creation of SIDs and water and sewer
hookup fees, to said contiguous tract is the subject of a written agreement between the City and Norman
Benjamin, record owner of the tracts; and
WHEREAS, said contiguous tracts are the subject of a plat
or Certificate of Survey, filed in the
office of the Gallatin County Clerk and Recorder's Office; and
WHEREAS, the Bozeman City Commission hereby finds that the
annexation of this contiguous
tract is in the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of
the contiguous tract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of
the City of Bozeman,
Montana:
Section 1
That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 43, M.C.A., the following-described
property, which is contiguous to the municipal boundaries of the City of Bozeman, be annexed to the City

of Bozeman and that the boundaries of said City shall be extended so as to embrace and include such
2.1674 acres of land, to wit:
A tract of land being described as Tracts 1A and 2A, C.O.S.
E-9-C, Longacres
Subdivision, located in the Northeast one-quarter of Section
19, Township 2 South,
Range 6 East of the Montana Principal Meridian, Gallatin
County, Montana, more
particularly described as follows:
Commencing at the Northeast corner of said Section 19, thence
South 88043'39"
West along the north line of said Section 19, a distance
of 810.35 feet to the True
Point of Beginning. Thence continuing along said north line
of Section 19 South
88043'39" West a distance of 312.76 feet to the intersection
of said north line and the
centerline of Sourdough Road. Thence South 13020'50" East
along the centerline of
said Sourdough Road a distance of 347.88 feet to the westerly
projection of the south
line of Tract 2A of Certificate of Survey No. E-9-C. Thence
North 87041 '35" East
along said south line and its westerly projection a distance
of 245.48 feet to the west
line of the tract described on Film 30, Page 2243 of Gallatin
County records. Thence
North 02012'17" West along said west line and its northerly
projection a distance of
335.79 feet to the north line of said Section 19 and the
True Point of Beginning.
Section 2
The effective date of this annexation is June 1, 2003.
Section 3
The annexation of the above-described tract is subject to
the terms of the Agreement dated
January 14, 2003, by and between the City of Bozeman and Norman Benjamin.
PASSED AND ADOPTED by the City Commission of the City of
Bozeman, Montana, at a
regular session thereof held on the 19th day May 2003.
