COMMISSION RESOLUTION NO. 3608 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, PROVIDING FOR THE ANNEXATION OF A CERTAIN CONTIGUOUS TRACT OF LAND, HEREINAFTER DESCRIBED, TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACT. WHEREAS, the City of Bozeman received a request for annexation from Montana Conference Association of Seventh-Day Adventists, owner of the tract, requesting the City Commission to extend the boundaries of the City of Bozeman so as to include a certain contiguous tract of land lying between Haggerty Lane and 1-90 at Ellis Street extended in the County of Gallatin, State of Montana; and WHEREAS, an annexation staff report has been prepared in accordance with the Commission's goals and policies for annexation and was presented to the Commission on April 14, 2003; and WHEREAS, Commission Resolution No. 3589 was adopted by the City Commission on April 14, 2003, declaring it to be the intent of the City of Bozeman to extend the boundaries of said City so as to include said contiguous tract within the corporate limits of the City; and WHEREAS, a public hearing on Commission Resolution No. 3589 was duly noticed and held on May 12, 2003; and WHEREAS, no objections to said annexation were raised at the public hearing; and WHEREAS, the City did not receive any written protest from the real property owners of the area to be annexed; and WHEREAS, on May 12, 2003, the Commission authorized and directed staff, upon satisfaction by the applicant of the terms of approval, to prepare the necessary documents to proceed with the annexation of this tract in accordance with Commission Resolution No. 3589; and WHEREAS, the provision of available services, including, but not limited to, rights-of-way, easements, water rights or cash in lieu, waivers of protest against creation of SID's and water and sewer hookup fees, to said contiguous tract is the subject of a written agreement between the City and Montana Conference Association of Seventh-day Adventists, record owner of the tract; and -,- WHEREAS, said contiguous tract is the subject of a plat or Certificate of Survey, filed in the office of the Gallatin County Clerk and Recorder's Office; and WHEREAS, the Bozeman City Commission hereby finds that the annexation of this contiguous tract is in the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tract. ~>{ 1111111111111111111111111111111111111111111111111111111 ~~t~~~~~~~R SMelley Vance-GallatIn Cc MT MISC 24.00 n. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 43, M.C.A., the following- described property, which is contiguous to the municipal boundaries of the City of Bozeman, be annexed to the City of Bozeman and that the boundaries of said City shall be extended so as to embrace and include such 13.946 acres of land, to wit: A parcel of land being the tract described in Film 71, Page 1010, and also the 160 foot wide strip of land described as "Station 54+49.1 to Station 69+60.0 HAGGERTY LANE FRONT AGE ROAD" in Film 4, Page 1, all documents being in Gallatin County records, said parcel of land lying in the SW~, SE~ of Section 8, Township 2 South, Range 6 East, P.M.M., Gallatin County, Montana, and lying between the southwesterly right of way line of the Haggerty Lane Frontage Road and the southwesterly right of way line of Montana State Highway Project IIG 90-6( 1 ) 303, and being more particularly described as follows: Beginning at a point on the south line of said Section 8, which point being the south one-sixteenth corner of the SE~ of said Section 8, and bears South 89054'41" West a distance of 1325.42 feet from the southeast corner of said Section 8; thence continuing South 89054'41" West on and along the south line of said Section 8, a distance of 125.45 feet to a point where the south line of said Section 8 intersects the northeasterly right of way line of the Haggerty Lane Frontage Road; thence South 89054'41" West along said south line of Section 8, a distance of 261.8 feet more or less to the southwesterly right of way of said Haggerty Lane; thence North 52025' West along the southwesterly right of way line of the Haggerty Lane Frontage Road, a distance of 1181.5 feet more or less to the west line of the SW~, SE~ of said Section 8; thence North 0021'39" West, along said west line, a distance of 202.9 feet more or less to a point where the northeasterly right of way line of Haggerty Lane Frontage Road intersects the west line of the SW~, SE~ of said Section 8, which point is 80.0 feet left when measured at right angles to Engineer's Centerline Station 54+43.59; thence North 0021'39" West, a distance of 159.97 feet to a point where the west line of the SW~, SE~ of said Section 8 intersects a point 400 feet distant southwesterly, when measured radially from Station 178 + 40.0 of the Median Centerline of Montana State Highway Project IIG 90-6( 1) 303; thence South 63007'34" CSt a .....
