curve concave to the northwest, radius 1086.00 feet and central angle of 22'49'12"; southerly 16238'26" azimuth 20.00 feet normal to said curve to a point an a curve with the center of circle lying northerly 342'26'52" azimuth 1106.00 feet;

The above-described tract of land is to be known and designated as CREEKWOOD SUBDIVISION, City of Bozeman, Gallatin County, Montana; and the lands included in all streets, avenues, alleys, and parks or public squares, with exception to the
lands shown as"Open Space, Public Space". which includes the watercourse, wetlands and watercourse setback, shown on said plat are hereby granted and donated to the City of Bozeman for the public use and enjoyment. Unless specifically
listed herein, the lands included in all streets, avenues, alleys, and parks or public squares dedicated to the public are accepted for public use, but the City accepts no responsibility for maintaining the some. The owner(s)agree(s) that the City
has no obligation to maintain the lands included in all streets, ovenues, alleys, parks or public square hereby dedicated to public use. The lands included in all streets, avenues, alleys, and parks or public squares dedicated to the public for which
the City accepts responsibility far maintenance include: none.
The undersigned hereby grants unto each and every person, firm or corporation, whether public or private, providing or offering to provide telephone, electric power, gas, Internet, cable television or other similar utility or service, the right to

NOTES
1. Property shown heron was annexed to the City of Bozeman pursuant to Annexation Agreement recorded an Dec. No. 2209988, and Commission Resolution No. 3841 recorded on Doc. No. 2209989.
2. All lot accesses shall be built to the standards contained in the Bozeman Municipal Code.
3. Development will not interfere with any agricultural water user facility or irrigation ditches for downstream user rights.
4. City standard residential sidewalks shall be constructed on all public street frontages of a property prior to occupancy of any structure an the property. Upon the third anniversary of the plat recordation of the
subdivision, any lot owner who has not constructed said sidewalk shall, without further notice, construct within 30 days said sidewalk for their lot(s), regardless of whether other improvements hove been made
upon the lot.
5. Due to the potential of high ground water conditions in the area of the subdivision, it is not recommended that residential dwellings or commercial structures with full or partial basements be constructed without
first consulting a professional engineer licensed in the State of Montana and qualified in the certification of residential and commercial construction.
6. Due to the high risk of flooding all structures are required to be flood proofed at a least 2' above the 100 year flood level. An Elevation Certificate must be provided for each building following completion of
construction.
7. All areas labeled"Public Park" are to be dedicated to the City, and maintained by the Homeowner's Association. All areas labeled"Open Space, Public Access" shall be owned and maintained by the Homeowner's Ic Mi
