COMMISSION RESOLUTION NO. 3648
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS
TRACTS OF LAND, HEREINAFTER DESCRIBED, TO THE CORPORATE LIMITS
OF THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF
THE CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACTS.
WHEREAS, the City of Bozeman received a request for annexation from David MacDonald of
D.M.C., David MacDonald Construction, Inc., on behalf of the Estate of Eula May Lessley, previous
owner of two adjacent tracts, requesting the City Commission to extend the boundaries of the City of
Bozeman so as to include certain contiguous tracts of land lying along the north side of West Babcock
Street, south of West Beall Street, and west of the City of Bozeman Kirk Park in the County of Gallatin,
State of Montana; and
WHEREAS, an annexation staff report has been prepared in accordance with the Commission's
goals and policies for annexation and was presented to the Commission on May 28, 2002; and
WHEREAS, Commission Resolution No. 3518 was adopted by the City Commission on May
28, 2002, declaring it to be the intent of the City of Bozeman to extend the boundaries of said City so as
to include said contiguous tracts within the corporate limits of the City; and
WHEREAS, a public hearing on Commission Resolution No. 3518 was duly noticed and held
on July 15, 2002; and
WHEREAS, no objections to said annexation were raised at the public hearing; and
WHEREAS, the City did not receive any written protest from the real property owners of the
area to be annexed; and
WHEREAS, on July 15, 2002, the Commission authorized and directed staff, upon satisfaction
by the applicant of the conditions of approval, to prepare the necessary documents to proceed with the
annexation of these tracts in accordance with Commission Resolution No. 3518; and
WHEREAS, the tracts were subsequently conveyed to David A. MacDonald and Cheryl M.
MacDonald, current owners of the subject property; and
WHEREAS, the provision of available services, including, but not limited to, rights-of-way,
easements, water rights or cash in lieu, waivers of protest against creation of SID's and water and sewer
hookup fees, to said contiguous tracts as described is the subject of a written agreement between the
City and David A. MacDonald and Cheryl M. MacDonald, record owners of said tracts; and
WHEREAS, said contiguous tracts are the subject of a plat or Certificate of Survey, filed in the
office of the Gallatin County Clerk and Recorder's Office; and
WHEREAS, the Bozeman City Commission hereby finds that the annexation of these
contiguous tracts is in the best interests of the City of Bozeman and the inhabitants thereof and of the
inhabitants of the contiguous tracts.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:

That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 43, M.C.A., the following-
described property, which is contiguous to the municipal boundaries of the City of Bozeman, be annexed
to the City of Bozeman and that the boundaries of said City shall be extended so as to embrace and
include such 10.7 acres of land, to wit:
Tracts 1 A and 2A, Certificate of Survey No. 1855A, as recorded with the Gallatin
County Clerk and Recorder, located in the northeast one-quarter of Section 11,
Township 2 South, Range 5 East, Principal Meridian Montana, Gallatin County State
of Montana and being more particularly described as follows.
Beginning at the NE corner of said Tract 2A, thence along said Tracts 2A and 1A
through the following courses: SOO.11'03"W, a distance of 30.18 feet; SOO.06'20"W,
a distance of 30.18 feet; SOO.06'20"W, a distance of 24.25 feet; SOO.12'31"W, a
distance of 667.74 feet; SOO'06'12"W, a distance of 625.87 feet; SOO.04'57"E, a
distance of 41.79 feet; S88'14'47"W, a distance of 329.36 feet; NOO'25'42"W, a
distance of 45.02 feet; NOO.00'43" W, a distance of 409.01 feet; NOO'01'21" W, a
distance of 213.04 feet; NOO.05'28"W, a distance of 375.63 feet; NOO.06'58"E, a
distance of 56.65 feet; NOO'13'02"E, a distance of 55.45 feet; NOO.22'07"W, a
distance of 54.84 feet; NOO.04'40"W, a distance of 61.00 feet; NOO.06'28"E, a
distance of 63.56 feet; NOO'05'51 "E, a distance of 29.91 feet; NOO.05'51 "E, a distance
of 30.18 feet; N83.52'57"E, a distance of 335.82 feet to the point of beginning. Said
tracts of land containing 1 0.70 acres more or less along with and sUbject to any and
all existing easements.
Section 2
The effective date of this annexation is January 25, 2004.
Section 3
The annexation of the above-described tract is subject to the terms of the Agreement dated
September 15, 2003, by and between the City of Bozeman and David M. MacDonald and Cheryl A.
MacDonald.
