Present were Mayor Jeff Krauss, Commissioner Cyndy Andrus, Commissioner Sean Becker, Commissioner Chris Mehl, Commissioner Carson Taylor, City Manager Chris Kukulski, Assistant City Manager Chuck Winn, Finance Director Anna Rosenberry, City Attorney Greg Sullivan and City Clerk Stacy Ulmen. * * Please refer to the audio recording of this meeting far additional detail. 0 :11 :58 A. Call to Order — 6 p.m. — Commission Room, City Hall, 121 North Rouse Mayor Krauss called the Meeting to order at 6:03 p.m. 0,12,01B. Discussion with the Bozeman Historic Preservation Advisory Board on the purpose, scope, and Commission direction on their duties, including the formulation of new policy such as a Demolition by Neglect Ordinance, as well as training on Historic Preservation for the Commissioners (Kramer) 0 :13 :41 Mark Hufstetler, Chair of the BHPAB Mr. Hufstetler called the meeting to order for the BHPAB. 0:14:02 Courtney Kramer, Staff representative on the BHPAB Ms. Kramer began the staff presentation regarding the discussion with the Bozeman Historic Preservation Advisory Board on the purpose, scope, and Commission direction on their duties, including the formulation of new policy such as a Demolition by Neglect Ordinance, as well as training on Historic Preservation for the Commissioners. 0:32:44 Cr. Andrus Cr. Andrus asked that "Intrusive" be defined and additionally she would like information about the Historic Preservation Officer. Mehl Cr. Mehl asked that the Board's goals be emailed to him. He also spoke regarding his concern of boards hosting their own web pages outside of the City's website. 0:38:08 Public Comment Mayor Krauss opened public comment. No person commented. Mayor Krauss closed public comment. 0-38:59 Mark Hufstetler, Chair of the BHPAB Mr. Hufstetler spoke regarding the importance of communication. He spoke regarding the need to discuss process and the informational historic data base. He spoke regarding the board's website which has their own domain site, It is hosted on City Servers. He spoke regarding the definition of terms of "Neutral" and "Intrusive". 0.46:15 Board Member Introductions Each Board Member introduced themselves to the Commission including: Crystal Alegria, Lora Dalton, Ryan Olson, Bruce Brown, Boone Nolte, Jane Klockman, Dale Martin and Paul Reichert. 0:48.22 Mayor Krauss Mayor Krauss spoke regarding advocacy. How can advocacy be set aside when reviewing applications? He spoke regarding processes of an Advisory Board. 0:52:59 Ms. Kramer Ms. Kramer spoke regarding the need to rely on the facts. 0:54:33 Mayor Krauss Mayor Krauss spoke regarding Minutes. He is looking at whether or not the Board is comparing to the standards. 0:55:25 Ms. Kramer Ms. Kramer stated that the surcharge has been working well for paying for the inventory. Inventory is always going to get older, possibly the program should be revamped. Possibly establish a local historic district. 0:59:06 Mr. Hufstetler Mr. Hufstetler spoke regarding perception of the Board. He also spoke regarding the timing of Board application review. He spoke regarding the minutes. He stated that he does not support the creation of a district. This board exists to be a resource to the City Commission, 1:10:54 Cr. 'Taylor Cr. Taylor spoke regarding the importance of the Commission Liaison needs to be at the meetings as well as the staff. He feels that only one person on staff should be involved with the board. 1.20:20 Stacy Ulmen, City Clerk Ms. Ulmen stated that the Clerk's Office will help educate the Board on minutes. 1.23 :14 Mr. Hufstetler Mr. Hufstetler suggested looking at project designations. 1:27.15 Mr. Hufstetler Mr. Hufstetler spoke regarding the difficulty to quantify. 1:29:2.4 Cr. Andrus Cr. Andrus questioned the order of how things are reviewed. 1:29:40 Ms. Kramer Ms. Krasner spoke regarding the process. The question is how to see it sooner. We do not see it until it is on paper. 1 :31:29 Cr. Taylor Cr. Taylor suggested possibly having standards that are flexible. 1 :31:51 Mr. Hufstetler Mr. Hufstetler feels that would be helpful. 1:33 :02 Mayor Krauss Mayor Krauss spoke regarding the Unified Development Ordinance and how it should address who sees which projects. If it does not, we should follow -up. 1:34:00 Mayor Krauss Mayor Krauss stated that applicants appreciate predictability. 1:35:35 Mayor Krauss Mayor Krauss spoke regarding subcommittees. 1:37:02 Mr. Hufstetler Mr. Iufstetler stated that a subcommittee concept is a good idea. Andrus spoke regarding the number of member positions on the Board. 1:42:01 Ms. Kramer Ms. Kramer spoke regarding a recent historic walk coming up and invited the Commission to attend. 1:42:55 Cr. Mehl Cr. Budget Work Session - Special Revenue Funds (Rosenberry) 2:00:02 Anna Rosenberry, Finance Director Ms. Rosenberry gave the staff presentation regarding the Budget Work Session, Special Revenue Funds. These are not all, but some of the biggest players. We are having our first live forum tonight. She highlighted what will be discussed. 2,06:12 Bob Risk, Chief Building Official Mr. Risk presented the Building Department report. 2:11:27 Cr. Mehl Cr. Mehl spoke regarding the expenditures. 2:12.24 Cr. Becker Cr. Becker asked when the last time building permit fees changed. 2:12:33 Mr. Risk Mr. Risk stated 2007. Becker spoke regarding volume and the level of fees. 2:16:20 Ms. Rosenberry Ms. Rosenberry spoke regarding the building fees and the revenues projected for each month and the expenditures. 2:23:03 Ms. Rosenberry Ms. Rosenberry stated that the increase in expenditures is partly due to personnel and training costs. 2.25:28 Mr. Risk Mr. Risk spoke regarding the recent code change, thus the reason for the training. 2:33 :53 Mayor Krauss Mayor Krauss spoke regarding premium services. 2:35:06 Mr. Risk Mr. Risk spoke regarding service, 2.50.32 Mayor Krauss The Mayor asked that the remainder of the Special Revenue Funds be added to next week's agenda. Public Comment Mayor Krauss opened public comment. 2:53:40 Randy Wall, Public Comment Mr. Wall of 530 East Cottonwood Street spoke regarding the work session with the Historic Design Review Board. Ile thanked the Commission for having the work session. Ile spoke regarding the historic inventory in Bozeman. 2.59:06 Public Comment Closed Mayor Krauss closed public comment. 2:59:13 H. Special Presentation — Yellowstone Business Partnership presentation on Sustainable Communities Grant Participation opportunity and request for City Participation (Saunders) 2:59.29 Chris Saunders, Interim Planning Director Mr. Saunders began the Special Presentation regarding the Yellowstone Business Partnership presentation on Sustainable Communities Grant Participation opportunity and request for City Participation. 3:00:25 Jan Brown, Yellowstone Business Partnership Ms. Brown gave the Special Presentation regarding the Yellowstone Business Partnership Sustainable Communities Grant Participation opportunity and request for City Participation. This business is organized here in Bozeman. She spoke regarding criteria based on LEER. There are several things in the Commission's Work Plan that would qualify in a Pilot program. 3:10:39 Cr. Becker Cr. Becker asked what the City's current contribution to YBP totals. 3:10:48 Mr. Kukulski Mr. Kukulski stated that it is a minimal amount, 3:12:30 Mr. Saunders Mr. Saunders stated that if the City decides to take part in the Pilot Program, there will be some staff commitment. 3:24:21 Public Comment Mayor Krauss opened public comment. Final Adoption of Ordinance No. 1786, Regulating the Use of Medical Marijuana (Sullivan) 3:28:50 Greg Sullivan, City Attorney Mr. Sullivan gave the staff presentation regarding the Final Adoption of Ordinance No. 1786, regulating the use of Medical Marijuana. He highlighted the changes that took place during the provisional adoption of the ordinance that have been incorporated into this draft. 3:34:05 Mr. Sullivan Mr. Sullivan spoke regarding the number of applications in process. 3:38:10 Mr. Sullivan Mr. Sullivan stated that the licenses are not transferable. 3:38:31 Public Comment Mayor Krauss opened public comment. 3:38:45 Jason Meyers, Public Comment Mr. Meyers of 3303 Sora Way thanked the Commission for recognizing that this is an area of concern. He recently became a caregiver in Bozeman. He spoke regarding quality of care. He asked that there be a reconsideration of the Cap. 3:41:06 Jim Ginzery, .Public Comment Mr. Gingery complimented the City. There are people waiting on what the final rules will be. He does not agree with the Cap. He spoke regarding business licenses (not just store fronts) and urged that they be capped. Ile urged a Moratorium of dispensaries. 3:47:30 Public Comment Closed Mayor Krauss closed public comment. 3:48:04 Motion to incorporate the Findings from the July 12, 2010 hearing on provisional adoption including all zoning related findings, and finally adopt Ordinance No. 1786 as amended by the Commission during the provisional adoption on July 12, 2010. It was moved by Cr. Becker, Seconded by Cr. Any application for a license submitted hereunder after August 25, 2010 shall be subject to the maximum allowable licenses and all otherprovisions of this Title. This subsection shall repeal automatically one year after the effective dated it this ordinance. " It was moved by Cr. Taylor, Seconded by Cr. These shall be the following types of business licenses related to Medical Marijuana activities conducted in the City regardless of whether the Medical Marijuana is sold, bartered, exchanged, or g�fted: 1. StorefonVRetail Locations. A ny person or entity that provides a location other than the residence of the person's or entity's qualifying patients) where transaction or use related to Medical Mar Juana is engaged in for more than three (3) qualifying patients registered by the State of Montana to the applicant or the applicant's employees or agents shall prior to engaging in such transaction or use obtain a Medical Marijuana Store Front License. As of August 25, 2010 the maximum number of Medical Marijuana Storefront licenses shall be 20. The limitation on the maximum number of licenses under this subsection shall repeal automatically one year after the effective date if this ordinance. 2. Delivery: A ny person or entity that delivers Medical marijuana within the City to more than three (3) qualifying patients or another entity regardless of whether the Medical Marijuana is sold bartered, exchanged, or gifted shallprior to engaging in such activity obtain a Medical Marijuana Delivery licenses. Growing andlor Processing: Any person or entity that operates a facility for the purpose of growing andlor processing medical marijuana shall prior to engaging in such activity obtain a Medical Marijuana Grow license. A person or entity desiring to engage in an activity related to medical marijuana must obtain a separate license for each activity described above except a person, or entity obtaining a Medical Marijuana Store Front Licenses may also under said license deliver medical marijuana from that location without obtaining a separate Medical Marijuana Delivery Licenses.
