COMMISSION RESOLUTION NO. 3660
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, REVISING THE DEED RESTRICTION REQUIRED FOR SALE OF THE
BOZEMAN ARMORY.
WHEREAS, the State of Montana Department of Military Affairs has constructed a new Armory
for the Bozeman unit of the Montana National Guard; and
WHEREAS, the Bozeman Armory building located at 24 West Mendenhall Street has
subsequently been deemed surplus property; and
WHEREAS, the State of Montana Department of Natural Resources and Conservation Trust
Land Management Division has pursued the disposal of the surplus property; and
WHEREAS, the City of Bozeman has acquired the Bozeman Armory for a pUblic purpose
through exercising the provisions of Section 77-2-351, M.C.A.; and
WHEREAS, Commission Resolution No. 3620, adopted on the 22nd day of September 2003,
authorized the City Manager to pursue sale of the Armory Building for the best offer over $815,000; and
WHEREAS, Commission Resolution No. 3620 included the requirement that a deed restriction
be placed on said property that limits its use to being part of a performing arts center complex in the
downtown; and
WHEREAS, it has been determined to be in the best interests of the City to sell the Bozeman
Armory Building and property to another party by the standard real estate transaction process with
termination provisions on the deed restriction.
NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that Ron Brey, Acting City Manager of the City of Bozeman, is hereby authorized to sell the
Bozeman Armory Building, with a deed restriction providing that the property will be used as part of a
performing arts center complex, or other public use that complements the downtown area. This deed
restriction will cease six months from the date of sale.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 1 st day of March 20
