CITY COMMISSION RESOLUTION NO, 3677
A JOINT RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AND THE BOARD OF COUNTY COMMISSIONERS OF GALLATIN
COUNTY, MONTANA, RELATING TO THE CREATION BY THE CITY OF
BOZEMAN OF AN EXTENDED SPECIAL IMPROVEMENT DISTRICT NO. 678.
BE IT RESOLVED by the City Commission of the City of Bozeman, Montana (the Commission),
and the Board of County Commissioners of Gallatin County, Montana (the Board), as follows:
Section 1. Recitals. Section 7-12-4102(3), M.C.A., authorizes a City to create and include
within special improvement districts properties and projects abutting the city limits where the proposed
district improvements abut and benefit such property, whenever the affected City and County have
adopted a joint resolution agreeing to the terms of the special improvement district prior to the City's
passing the resolution of intention to create the district. The City is proceeding with the creation of a
special improvement district including lots, tracts or parcels that would be benefitted from such
improvement to pay a portion of the costs thereof, which special improvement district would contain one
parcel of land in the County abutting the City and benefitting from the improvements.
Section 2. Resolution of Intention. The Commission and the Board have reviewed the
proposed resolution of intention of the City (the Resolution of Intention) to create extended Special
Improvement District No. 678 (the District), appended hereto as Appendix A. the proposed boundaries
of which include property not within the boundaries of the city, but abutting the city, and the proposed
Special Improvement District No. 678, and benefitted thereby, specifically Tract 1, Certificate of Survey
No. 2050, Gallatin County, Montana.
Section 3. ADDroval of Terms and Conditions. The City and County, by the adoption of this
resolution, approve the creation of extended Special Improvement District No. 678 for the purposes and
in accordance with the terms and conditions set forth in the Resolution of Intention and authorize the City
to proceed with the adoption of the Resolution of Intention and the taking of all steps necessary to create
the District and to construct and finance the improvements contemplated thereby.
Section 4. Agreement of City. In accordance with the provisions of Section 7-14-4102(3),
M.C.A., the City will furnish to the County a copy of the Resolution of Intention and a copy of the
resolution creating extended Special Improvement District No. 678 upon adoption.
Section 5. Effective Date. This resolution shall become effective upon passage by both the
City and the County.
PASSED AND APPROVED by the Board of County Commission of Gallatin County, Montana,
this 6th day of April 2004.
