HomeMy WebLinkAbout10- North 7th Ave. Lighting, ROW, and preliminary design Amendment 2 to Professional Services AgreementAmendment No. 2 to Professional Services Agreement For North 7 Ave Lighting, ROW, and Preliminary Design THIS AGREEMENT is made as of this - A �,_ day of _ - �A �AA 2010, between THE CITY OF BOZEMAN, a Municipal Corporation, Bozeman, Montdna, herein referred to as OWNER and ALLIED ENGINEERING SERVICES INC., an Engineering Consulting Firm of Bozeman, Montana, herein referred to as ENGINEER. WHEREAS, the parties have entered into a Professional Services Agreement dated July 8, 2009, herein referred to as Original Agreement for professional engineering services; and WHEREAS, the parties have entered into Amendment No. I dated February 22, 2010, herein referred to as Amendment No. I for professional engineering services; and WHEREAS, the parties desire to further amend the provisions of this Agreement. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: 1. EXHIBIT C Modified Scope of Services will replace EXHIBIT B Modified Scope of Services for the remainder of the project as of 2010. 2. ARTICLE 4 of the original agreement relating to professional engineering services is amended to include the following additional services: 4.7 Phase I - Sidewalk lnfill - Construction Services: Allied Engineering will provide construction services for the North 7 th Avenue Urban Renewal District Improvements --- Phase I - Sidewalk Infill Project. 4.7.1 Construction Management - Engineer will coordinate with the Owner, perform internal correspondence /administration, review inspection reports and testing results, attend three monthly NSUR13 meetings, coordinate testing services with the Contractor, attend the Pre-Construction Meeting, attend the Final Walkthrough, and prepare Allied Engineering's portion of the documentation for HB645 reporting. 4.7.2 Construction Services - Engineer/Surveyors will perform construction survey staking including relevant office work preparing files and databases for staking, review of Contractor material submittals, perform concrete testing (temperature, slump, air content, casting and breaking cylinders) once per location for sidewalk (4 locations total) and once per location for curb and gutter (3 locations total), prepare inspection reports from concrete testing, and conduct construction inspection and site visits as requested by the Owner. Deliverables: Pre-Construction Meeting Agenda: two hard copies and an electronic copy (pdf). -1- 2. Construction Staking Notes: electronic copy (pdf). 3. Contractor Submittal Review: one hard copy and an electronic copy (pdf). 4. Concrete Test Results: electronic copy (pdf). 5. Final Walkthrough Punch List: electronic copy (pdf). ARTICLE 6.2.1 of the original agreement relating to compensation for Engineering Service is amended to read: "The OWNER shall pay an amount for Additional Services rendered by the ENGINEER and approved in writing by the OWNER on the basis of the ENGINEER'S Direct. Labor Costs times a factor of 3.20, or an amount otherwise negotiated at the time such services are requested and approved by the OWNER. The payment for construction phase services performed as Basic Engineering Services under section 4.7 of this agreement shall be completed on a time and materials basis for an estimated cost of $14,788 as shown on attached Exhibit C. In addition, the final cost for Basic Engineering Services under Section 4.7 shall not exceed 10% of the construction costs for the Phase I — Sidewalk Infill project." Except as specifically amended herein, the original agreement shall remain in full force and effect and the Parties shall be bound by all terms and conditions therein. MEETING DATE: July 26,2010 AGENDA ITEM TYPE: Consent RECOMMENDATION: The Commission to make a motion to authorize City Manager to sign. BACKGROUND: On April 2, 2009 the North Seventh Urban Renewal Board (NSURB) motioned and voted to approve the proposed professional services agreement with Allied Engineering for the Lighting & Right of Way Investigation, and Preliminary Design for North 7th Avenue. This contract was for $73,579 and included provisions for site evaluation, lighting studies, project and funding identification, and corridor character development. On September 14, 2009 NSURB submitted a request to the City Commission for funds allocated by House Bill 645 be directed to make significant improvements to pedestrian safety and connectivity along N. 7' Avenue. The bulk of the proposal included infill of sidewalk along the East side of North 7 Avenue in areas where sidewalk is missing. The City Commission motioned and voted to grant $110,400 to the board for their proposal. With this grant Allied Engineering was granted an amendment to their Professional Service for them to draft the construction documents and help secure a contractor. Bids for the sidewalk improvements were open on June 22, 2010 and Knife River Inc. was selected to do the work. The existing contract with Allied Engineering will expire with the execution of the Knife River contract. In discussions with staff and the NSURB it was decided that Allied Engineering should continue contract for construction management and services during this project. Amendment No. 2 to the Professional Services Agreement with Allied Engineering includes concrete testing, construction staking and surveying, site inspections, review of all pay requests and shop submittals, and overall project oversight. The bulk of this contract includes services such as testing and surveying that city staff is unable to perform. FISCAL EFFECTS: The contract will be paid out of the NSURB Big Box Funds, The bulk of the construction costs of the sidewalks will be paid out of the House Bill 645 funds granted to NSURB from the City Commission. Any cost over-runs will be paid out of the NSURB Big Box Funds. ALTERNATIVES: As suggested by the City Commission.
