The Commission of the City of Bozeman met in the Commission Room, City Hall at 121 North
Rouse on Monday, July 26, 2010. Present were Mayor Jeff Krauss, Commissioner Cyndy
Andrus, Commissioner Sean Becker, Commissioner Chris Mehl, Commissioner Carson Taylor,
City Manager Chris Kukulski, Assistant City Manager Chuck Winn, Finance Director Anna
Rosenberry, City Attorney Greg Sullivan and City Clerk Stacy Ulmen.

Mayor Krauss called the Meeting to order at 6:03 p.m.

Mayor Krauss welcomed everyone to the Commission Meeting.

0:12:51 1. Discussion with the Bozeman Historic Preservation Advisory Board on the
purpose, scope, and Commission direction on their duties, including the formulation of new
policy such as a Demolition by Neglect Ordinance, as well as training on Historic
Preservation for the Commissioners (Kramer)

Mr. Hufstetler called the meeting to order for the BHPAB.

Ms. Kramer began the staff presentation regarding the discussion with the Bozeman Historic
Preservation Advisory Board on the purpose, scope, and Commission direction on their duties,
including the formulation of new policy such as a Demolition by Neglect Ordinance, as well as
training on Historic Preservation for the Commissioners.

the Historic Preservation Officer.

Ms. Kramer stated that the Historic Preservation Officer position is split between her and another
Planner in the Planning Department.

Cr. Mehl asked that the Board’s goals be emailed to him. He also spoke regarding his concern of
boards hosting their own web pages outside of the City's website.

Mr. Hufstetler spoke regarding the importance of communication. He spoke regarding the need
to discuss process and the informational historic data base. He spoke regarding the board's
website which has their own domain site. It is hosted on City Servers. He spoke regarding the
definition of terms of “Neutral” and “Intrusive”.

Each Board Member introduced themselves to the Commission including: Crystal Alegria, Lora
Dalton, Ryan Olson, Bruce Brown, Boone Nolte, Jane Klockman, Dale Martin and Paul
Reichert.

Mayor Krauss spoke regarding advocacy. How can advocacy be set aside when reviewing
applications? He spoke regarding processes of an Advisory Board.

Ms. Kramer spoke regarding the need to rely on the facts.

Mayor Krauss spoke regarding Minutes. He is looking at whether or not the Board is comparing
to the standards.

Ms. Kramer stated that the surcharge has been working well for paying for the inventory.
Inventory is always going to get older, possibly the program should be revamped. Possibly
establish a local historic district.

Mr. Hufstetler spoke regarding perception of the Board. He also spoke regarding the timing of
Board application review. He spoke regarding the minutes. He stated that he does not support the
creation of a district.

Ms. Dalton spoke regarding the differences between “advocacy” and “ethics”. This board exists
to be a resource to the City Commission.

Cr. Taylor spoke regarding the importance of the Commission Liaison needs to be at the
meetings as well as the staff. He feels that only one person on staff should be involved with the
board.

Ms. Ulmen stated that the Clerk's Office will help educate the Board on minutes.

Mr. Hufstetler suggested looking at project designations.

Mr. Hufstetler spoke regarding the difficulty to quantify.

Cr. Andrus questioned the order of how things are reviewed.

Ms. Kramer spoke regarding the process. The question is how to see it sooner. We do not see it
until it is on paper.

Cr. Taylor suggested possibly having standards that are flexible.

Mayor Krauss spoke regarding the Unified Development Ordinance and how it should address
who sees which projects. If it does not, we should follow-up.

Ms. Rosenberry gave the staff presentation regarding the Budget Work Session, Special Revenue
Funds. These are not all, but some of the biggest players. We are having our first live forum
tonight. She highlighted what will be discussed.

Mr. Wall of 530 East Cottonwood Street spoke regarding the work session with the Historic
Design Review Board. He thanked the Commission for having the work session. He spoke
regarding the historic inventory in Bozeman.

2:59:13 H. Special Presentation – Yellowstone Business Partnership presentation on
Sustainable Communities Grant Participation opportunity and request for City
Participation (Saunders)

Mr. Saunders began the Special Presentation regarding the Yellowstone Business Partnership
presentation on Sustainable Communities Grant Participation opportunity and request for City
Participation.

Ms. Brown gave the Special Presentation regarding the Yellowstone Business Partnership
Sustainable Communities Grant Participation opportunity and request for City Participation.
This business is organized here in Bozeman. She handed out the YBP's annual report and the

explanation of the services that they provide. She spoke regarding criteria based on LEED. There
are several things in the Commission's Work Plan that would qualify in a Pilot program.

Cr. Becker asked what the City's current contribution to YBP totals.

Mr. Kukulski stated that it is a minimal amount.

Marijuana (Sullivan)

Mr. Sullivan gave the staff presentation regarding the Final Adoption of Ordinance No. 1786,
regulating the use of Medical Marijuana. He highlighted the changes that took place during the
provisional adoption of the ordinance that have been incorporated into this draft.

Mr. Sullivan stated that the licenses are not transferable.

Mr. Meyers of 3303 Sora Way thanked the Commission for recognizing that this is an area of
concern. He recently became a caregiver in Bozeman. He spoke regarding quality of care. He
asked that there be a reconsideration of the Cap.

Mr. Gingery complimented the City. There are people waiting on what the final rules will be. He
does not agree with the Cap.

Mr. Wall of 530 Cottonwood Street stated his concern of the abuse of the State Medical
Marijuana Act. He spoke regarding business licenses (not just store fronts) and urged that they be
capped. He urged a Moratorium of dispensaries.

adoption including all zoning related findings, and finally adopt Ordinance No. 1786 as

130, moving the current subsection F. to G. and include a new subsection F. to read: "An
application for a business license under this section submitted prior to but not approved before
August 25, 2010 shall not be subject to the limitation on the maximum number of licenses but
shall be subject to all other provisions of this Title. Any application for a license submitted
hereunder after August 25, 2010 shall be subject to the maximum allowable licenses and all
other provisions of this Title. This subsection shall repeal automatically one year after the
effective dated it this ordinance."
It was moved by Cr. Taylor, Seconded by Cr. Andrus to amend section 5.060.020 found on

Finance and pay the fee(s) for such license(s)as established by the title, an activity where a
duly licensed medical doctor engages in the review of a person's medical condition for
purposes of recommending medical marijuana and who does not provide medical marijuana
to qualifying patient is not subject to these licensing requirements but may be subject to other
requirements if this Code. These shall be the following types of business licenses related to
Medical Marijuana activities conducted in the City regardless of whether the Medical
Marijuana is sold, bartered, exchanged, or gifted:
1. Storefont/Retail Locations: Any person or entity that provides a location other than the
residence of the person's or entity's qualifying patient(s) where transaction or use related to
Medical Marijuana is engaged in for more than three (3) qualifying patients registered by the
State of Montana to the applicant or the applicant's employees or agents shall prior to
engaging in such transaction or use obtain a Medical Marijuana Store Front License. As of
August 25, 2010 the maximum number of Medical Marijuana Store front licenses shall be 20.
The limitation on the maximum number of licenses under this subsection shall repeal
automatically one year after the effective date if this ordinance.
2. Delivery: Any person or entity that delivers Medical marijuana within the City to more
than three (3) qualifying patients or another entity regardless of whether the Medical
Marijuana is sold bartered, exchanged, or gifted shall prior to engaging in such activity obtain
a Medical Marijuana Delivery licenses.

3. Growing and/or Processing: Any person or entity that operates a facility for the
purpose of growing and/or processing medical marijuana shall prior to engaging in such
activity obtain a Medical Marijuana Grow license. A person or entity desiring to engage in an
activity related to medical marijuana must obtain a separate license for each activity described
above except a person or entity obtaining a Medical Marijuana Store Front Licenses may also
under said license deliver medical marijuana from that location without obtaining a separate
Medical Marijuana Delivery Licenses.”
It was moved by Cr. Taylor, seconded by Cr. Becker to amend Section 4 of 5.06.020 A.

4:36:05 Amendment to the Main Motion to amend section 5.06.020 D. to add the following
Subsection v. : " Each applicant for a business license shall provide a detailed statement
regarding the nature of activities related to medical marijuana for which the applicant is
engaged in and the specific licenses for which an application is being submitted."
It was moved by Cr. Taylor, Seconded by Cr. Becker to amend section 5.06.020 D. to add
the following Subsection v. : " Each applicant for a business license shall provide a detailed

statement regarding the nature of activities related to medical marijuana for which the
applicant is engaged in and the specific licenses for which an application is being submitted."

4:37:18 Amendment to the Main Motion to amend Section 5.05.010 under Specific
Businesses to amend the Licensing fees to read: “Registration and License Fee ($25.00);
Special Services and Regulatory Inspection Fee ($125.00) and Total Fee ($150.00). The
registration and license fee shall apply for each license type required under 5.06.020 A. A
special services and regulatory inspection fee shall not be required for a Medical Marijuana
Delivery License. If a person or entity applies for both a Medical Marijuana Storefront license
and a Medical Marijuana Grow license two registration and Licenses Fees shall be required
but only one Special Services and Regulatory Inspection fee shall be required.”
It was moved by Cr. Taylor, seconded by Cr. Becker to amend Section 5.05.010 under
specific businesses to amend the Licensing fees to read: “Registration and License Fee

Marijuana Grow license two registration and Licenses Fees shall be required but only one
Special Services and Regulatory Inspection fee shall be required.”
