Present were Mayor Jeff Krauss, Commissioner Cyndy Andrus, Commissioner Sean Becker, Commissioner Chris Mehl, Commissioner Carson Taylor, City Manager Chris Kukulski, Assistant City Manager Chuck Winn, City Attorney Greg Sullivan, Finance Director Anna Rosenberry and City Clerk Stacy Ulmen. * * Please refer to the audio recording of this meeting for additional detail. 0:23:28 A. Call to Order – 5 p.m. – Commission Room, City Hall, 121 North Rouse Mayor Krauss called the Meeting to Order. 0:23:32 C. Pledge of Allegiance and a Moment of Silence 0:24:41 D. Changes to the Agenda Mayor Krauss asked the City Manager if there were any changes to the Agenda. 0:24:42 Chris Kukulski, City Manager Mr. Kukulski stated that there were not any changes to the Agenda. 0:24:50 B. City of Bozeman Adopted 2010-2011 Work Plan Update (Kukulski) (estimated to take 1 ½ hours) 0:25:06 Mr. Kukulski Mr. Kukulski gave the staff presentation regarding the City of Bozeman Adopted 2010-2011 Work Plan Update. The new updates are in blue within the document. 0:28:19 Mayor Krauss Mayor Krauss spoke regarding enhancing the downtown development opportunities. Andrus spoke regarding the Parking Study. The contract will be signed this week. Taylor spoke regarding leash free parks. 1:16:21 Mr. Fontenot Mr. Fontenot spoke regarding what the analysis will include. 1:17:19 Ron Dingman, Director of Parks and Recreation Mr. Dingman spoke regarding a comprehensive inventory on the parks and trails. There will be a future presentation and discussion on a possible Parks Maintenance District. 1:18:40 Cr. Taylor Cr. Special Presentation – Swearing In Ceremony of New Police Chief Ron Price Mr. Kukulski swore in new Police Chief Ron Price. Mrs. Price pinned on the Chief's Badge. 1:54:44 E. Public Service Announcements 1:55:091. The Gallatin Art Crossing 2010-11 Public Art Installation and Reception Tate Chamberlin with the Gallatin Art Crossing invited the Commission and Public to attend an Arts Reception to view sculptures. This will begin at the Public Library on Saturday July 17th starting at 5:30 p.m. 1:57:09 2. Public Comment 2:03:01 Chris Musman, Public Comment Ms. Musman of 1087 Stoneridge spoke regarding marijuana. In the building that her business was previously located, marijuana is present and she went into shock twice from the odor. She has lost some income. This was an allergic reaction and it is life threatening to her. She is concerned about marijuana in buildings and her allergic reaction to it. 2:05:00 Barbra Hansmon, Public Comment Ms. Hansmon of 1117 North 7th, Suite No. 2. stated that she worked in the same building as Ms. Musman. She had the same issues. Mayor's State of the City Address (Mayor Krauss) Mayor Krauss gave the Mayor's State of the City Address. He stated that the City is a great place to live. He has been here for 35 years. He feels the need to talk about Bozeman. We have soul. We have a strong middle class here. This sometimes is not found in a resort town. There have been Investors on Main and 19th. We have a great appeal to retirees. We have a great chance to create a 2 year college. We have soul in the mountains. We can walk home safe at night and feel safe during early morning runs. It is in our local business people. It is in the hard work of individuals. We have a constant replenishment when students come in. It takes creative people to live here. He spoke regarding sustainability. We have some crumbling infrastructure. We need to maintain infrastructure and get away from finger pointing. He spoke regarding personnel in the City and added that there was a generational turn over recently. This has been beneficial to the City. He spoke regarding his unhappiness of how the hail storm was handled. We need to recognize that tax payers are not an unlimited source of funding. We need to look at jobs at the City. We need to be creative and responsive to the City's needs. We must compete in service. He spoke regarding Economic Development. He spoke regarding a sustainable Bozeman, the future of Bozeman. He spoke regarding protecting streams, having clean water, having room to grow, eliminating sprawl, the need for a 2 year community college, and a diversified economy. We need to accommodate and listen to each other. 2:40:28 K. Action Items 2:40:36 1. City of Bozeman Ethics Handbook (Sullivan) Mr. Sullivan began the presentation regarding the City of Bozeman Ethics Handbook. 2:40:48 Aimee Kissel, Deputy City Clerk Ethics Board staff support Aimee Kissel gave the staff presentation regarding the Ethics Handbook. The Board has been meeting and working on the handbook for over a year now. They have hired Paul Lachapelle from MSU to assist with the creation of the handbook. The handbook was sent out for peer review. She introduced the Ethics Board members. 2:42:27 Stephen Schultz, Ethics Board Member Mr. Schultz thanked staff and Mr. Lachapelle for their assistance. He stated that the Board thought about the Audience and that they wanted to create a handbook that was easy to understand. They looked at other cities and towns that have put handbooks together. The purpose of this item this evening is to set the appeal hearing date. 2:57:56 Susan Swimley, Applicant Representative Ms. Swimley gave the applicant presentation regarding the Kohl’s Site Plan/Certificate of Appropriateness Application Appeal of Administrative Decision No.C-10002. He spoke regarding land development, separation requirements and buffer areas around schools, business licenses, home based businesses and zoning districts. 4:13:40 Public Comment Mayor Krauss opened public comment. 4:14:15 Jim Gingery, Public Comment Mr. Gingery stated that he supports Ag definition. He has concerns with reporting within 10 days because daily changes occur. This is overkill. He spoke regarding Criminal and Civil offenses. 4:18:14 Blake Ogle, Public Comment Mr. Ogle of 618 West Griffin Drive thanked the City for taking an objective review on this issue. He is a large caregiver. There is a concern on the reporting. There has been an increase of activity. Some windows have been covered with black plastic. Recently two 13 year olds were trying to break into the house. The Commission is willing to give this a try for a couple of months. Mayor Krauss would like to make sure the packets are handed out at the end of the meetings. Hiring 17 year olds Mayor Krauss urged that the City hire 17 year olds, give them their first job. Maybe hire those with B averages. In this economy it is hard for them in the job market. 5:52:15 4. Impact Fees and Water rates Mayor Krauss spoke regarding paying for the future. He suggested possibly a stand by fee to build the water plant. 5:53:57 5.
