HomeMy WebLinkAboutResolution 3704 Establish fees for alcohol ordinance COMMISSION RESOLUTION NO. 3704 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ESTABLISHING AN OPEN CONTAINER WAIVER FEE AND A SCHEDULE OF SERVICE COSTS FOR OPEN CONTAINER WAIVERS. WHEREAS, the City Commission did, on the 12th day of July 2004, adopt Ordinance No. 1616, establishing a waiver for open containers; and WHEREAS, Ordinance No. 1616 provides for waiver fees and service costs to be established by resolution. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 Application for an open container waiver shall be made to the Director of Public Safety or his designee for events occurring within public parks, and to the City Manager for events in public parks with more than seventy-five (75) people, or for events in or on a public place other than a park. The application shall be made on a form to be provided by the City. Applications for events occurring in public parks, or in public places other than parks not involving street closures, shall be accompanied by a fee of twenty-five dollars ($25.00) for city residents and thirty-five dollars ($35.00) for non-city residents. This fee is in addition to any fee for a park reservation or public assembly permit. For events in public parks not involving over seventy-five (75) people, a public assembly permit application will not be required to accompany the open container waiver application. Applications for events in public places other than parks, or events in public parks involving more than seventy-five (75) people, shall be accompanied by a public assembly permit application and its associated fee. Applications for events which involve a street closure shall be accompanied by a fee of one hundred dollars ($100.00). This fee is in addition to the fee for the public assembly permit. Section 2 If the application includes a request for the use of any City equipment or if any City services shall be required, the applicant shall pay to the City of Bozeman a deposit toward actual costs for such use and/or services.
