PUBLIC ACCESS EASEMENT
NOPPER BUILDING, LLC, a Montana Limited Liability Company 900 Technology Boulevard,
Bozeman, MT 59715, GRANTOR, in consideration of $ 1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman,
Montana 59715, GRANTEE, its successors and assigns, a perpetual pathway easement for the
use of the public, in, through, and across a strip of land situated in Gallatin County, Montana,
to be located on the following described real property: LOT 1 IN BLOCK 1 OF ADVANCED
TECHNOLOGY PARK SUBDIVISION, PHASE II BEING A PORTION OF TRACT C -1 O
CERTIFICATE OF SURVEY NO. 1243A SITUATED IN THE NE 1 /4 OF SECTION 14
TOWNSHIP 2 SOUTH RANGE 5 EAST P M M CITY OF BOZEMAN GALLATIN
COUNTY MONTANA ACCORDING TO THE OFFICIAL PLAT THEREOF ON FILE AND
OF RECORD IN THE OFFICE OF THE COUNTY CLERK AND RECORDER OF
GALLATIN COUNTY MONTANA [PLAT J -1361, AND MORE PARTICULARLY
DESCRIBED AS A I 1 FOOT WIDE PATH EASEMENT RUNNING PARALLEL WITH
AND ADJACENT TO THE NORTH LINE OF LOT 1 IN BLOCK I OF THE ADVANCED
TECHNOLOGY PARK SUBDIVISION PHASE II [PLAT J -1361, WHOSE SOUTHERLY
LINE IS EXTENDED TO THE EASTERLY AND WESTERLY BOUNDARY LINES OF
SAID LOT CONTAINING 7,998 SQUARE F EET, M ORE OR LESS, OF WHICH 5,087
SQUARE FEET MORE OR LESS CONSTITUTE AN EXISTING 7 FOOT WIDE
SIDEWALK EASEMENT PER SAID PLAT.
The easement is more particularly described on the attached Exhibit which by this
reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.
