Box 1239 2364296 Bozeman, NIT 59771 1 - 1210 Page 1 of 3 06/29/2010 02 24 03 PM Fee $2100 Charlotte Mills - Gallatin Cunty MT MISC 111111111111111 IN 1111111111111111113 VIII 1111111111111111111 VIII III IIII College & Huffine Shared -Use Pathway — Bozeman Community Transportation and Enhancement Program (CT P) Proiect Project: STPE 1299(22) UPN 5946 PUBLIC ACCESS EASEMENT BIG SKY PUBLISHING, LLC GRANTOR, in consideration of $ 1.00 and for other and valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman, Montana 59715, GRANTEE, its successors and assigns, a perpetual pathway easement for the use of the public, in, through, and across a strip of land situated in Gallatin County, Montana, to be located on the following described real property: TRACT 1 OF THE WEST COLLEGE MINOR SUBDIVISION BEING A PORTION OF TRACT A -1 -A -2 OF CERTIFICATE OF SURVEY NO 1243 -C SITUATED IN THE NW' /4 OF SECTION 14 TOWNSHIP 2 SOUTH RANGE 5 EAST P M .M, C ITY OF BOZEMAN, GALLATIN COU NTY MONTANA MINOR SUBDIVISION NO 195 ACCORDING TO THE OFFICIAL PLAT THF.RF,OF ON FILE AND OF RECORD IN THE OFFICE OF THE COUNTY CLERK AND RECORDER OF GALLATIN COUNTY MONTANA AND MORE PARTICULARLY DESCRIBED AS: A 7 FOOT WIDE PATH EASEMENT RUNNING PARALLEL WITH AND ADJACENT TO THE NORTH LINE OF TRACT 1 OF THE WEST COLLEGE MINOR SUBDIVISION MINOR SUBDIVISION NO. 195 WHOSE SOUTHERLY LINE IS EXTENDED TO THE EASTERLY AND WESTERLY BOUNDARY LINES OF SAID TRACT CONTAINING 4,722 SQUARE FEET MORE OR LESS. The easement is more particularly described on the attached Exhibit which by this reference is made a part hereof. The GRANTOR states that he possesses the real property described above and that he has a lawful right to grant an easement thereon. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The GRANTEE agrees to indemnify, defend and hold the GRANTOR, its parent company, subsidiaries and affiliates, and their officers, directors, employees, agents, consultants or other representatives harmless from and against any and all claims, damages, losses and expenses, including but not limited to attorney's fees, resulting from the acts or omissions of the indemnifying party during performance of its obligations under this agreement. The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.
