SUBJECT: North 7th Sidewalk Infill – Van’s IGA - Public Access Easement

RECOMMENDATION: Authorize City Manager to sign
BACKGROUND: On September 14, 2009 North Seventh Urban Renewal Board (NSURB)
submitted a request to the City Commission for funds allocated by House Bill 645 be directed to make significant improvements to pedestrian safety and connectivity along N. 7th Avenue. The bulk of the proposal included infill of sidewalk along the East side of North 7th Avenue in areas
where sidewalk is missing. The City Commission motioned and voted to grant $110,400 to
NSURB for their proposal.
On June 7, 2010 easements from various property owners were approved on consent for the City Manager to sign. These easements made up the bulk of the sidewalk infill. Upon
further review it was determined that an additional easement would be necessary from Van’s
IGA for an embellished sidewalk section at the intersection of Tamarack and N. 7th, a
landscaping planter, and a concrete pad for a future bus stop. The attached easement will now allow for the construction for all contracted sidewalk and improvements along North 7th.
FISCAL EFFECTS: The easement was granted at no cost to the City of Bozeman or the
NSURB.
ALTERNATIVES: As suggested by the City Commission.
