HomeMy WebLinkAboutResolution 3718 Intent to amend urban renewal plan to extend life COMMISSION RESOLUTION NO. 3718 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING THE INTENTION TO EXTEND THE LIFE OF THE TAX INCREMENT FINANCING DISTRICT ESTABLISHED UNDER URBAN RENEWAL PLAN DATED NOVEMBER 1995 AND TO INCLUDE A PARKING GARAGE AS A SPECIFIED PROJECT IN THE PLAN, AND SETTING PUBLIC HEARING DATE. WHEREAS, on the 20th day of November 1995 the City Commission adopted Ordinance No. 1409, adopting by reference an Urban Renewal Plan for portions of the downtown area; and WHEREAS, under the section entitled "FINANCE" of the Urban Renewal Plan, tax increment payments made to the tax increment district shall terminate after the eleventh year of payments; and WHEREAS, the Downtown Bozeman Improvement District Board (lOB) has requested that the life of the tax increment financing district be extended to allow for its termination upon the fifteenth year following its adoption, as allowed under Section 7-15-4292. Montana Code Annotated; and WHEREAS, the construction of a parking garage in the downtown area would be in compliance with the implementation actions under the principles listed in the "IMPLEMENTATION ACTIONS" section of the Urban Renewal Plan but is not specifically identified; and WHEREAS, Section 7-15-4221, Montana Code Annotated, allows for modification of the Urban Renewal Plan. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that: Section 1 The City Commission of the City of Bozeman hereby declares its intent to amend the Urban Renewal Plan to extend the life of the tax increment financing district to terminate upon the fifteenth year following its adoption. It further declares its intent to amend the "IMPLEMENTATION ACTIONS" section of the Urban Renewal Plan to include the design and construction of a parking garage. Section 2 The regular meeting of the City Commission of the City of Bozeman to be held in the Commission Room in the City Hall on the 20th day of September 2004, at 7:00 p.m., and the same is hereby designated as the time and place at which public comment on the proposed extension will be received. ._n.___"._.. ,,___..___ Section 3 That the Clerk of the Commission of the City of Bozeman, is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in said City of Bozeman, a Notice signed by the Clerk of the Commission, as provided in Section 7-1-4127, Montana Code Annotated. The Clerk is further directed to mail a notice of the hearing, not less than ten days prior to the date of the hearing, to the persons whose names appear on the County Treasurer's tax roll as the owners or purchasers under contracts for deed of the property, at the address shown on the tax roll. COOP R - Acting City Attorney - 2 - NOTICE NOTICE IS HEREBY GIVEN that at a regular session of the Commission of the City of Bozeman held on the 23rd day of August 2004, Commission Resolution No. 3718 was duly and regularly passed and adopted. Said Resolution is entitled: COMMISSION RESOLUTION NO. 3718 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING THE INTENTION TO EXTEND THE LIFE OF THE TAX INCREMENT FINANCING DISTRICT ESTABLISHED UNDER URBAN RENEWAL PLAN DATED NOVEMBER 1995 AND TO INCLUDE A PARKING GARAGE AS A SPECIFIED PROJECT IN THE PLAN, AND SETTING PUBLIC HEARING DATE. Under the proposed modification of the Urban Renewal Plan the life of the tax increment financing district to terminate upon the fifteenth year fOllowing its adoption, rather than terminating after the eleventh year. This modification shall apply to all properties located within the original tax increment financing district, which is generally located in downtown Bozeman. Further, design and construction of a parking garage is to be added under the "IMPLEMENTATION ACTIONS" section of the Plan. Further information regarding the proposed modifications may be obtained from the Clerk of the Commission at the Municipal Building, 411 East Main Street, or by telephone at (406) 582-2320. A public hearing shall be held on Monday, September 20,2004, at 7:00 p.m. in the Commission Room of City Hall, at 411 East Main Street, Bozeman, Montana, for the purpose of hearing testimony in support of or in opposition to the proposed modification of the Urban Renewal Plan.
