SUBJECT: Reappointment and Affirmations to the Downtown Business Improvement
District Board (BID)
MEETING DATE: June 21, 2010

RECOMMENDATION: Reappoint one member to the Downtown Business Improvement
District Board (BID) and reaffirm the remainder of the Board members.
BACKGROUND: A Resolution to re-create/extend the Downtown Business Improvement
District was recently approved on June 21, 2010. The Board members serving out their current
terms should be re-affirmed by the Commission since a lapse occurred between the expiration of
the District and the Re-creation/Extension of the district. In addition, one term expired on the
BID board on June 30, 2010. The member with an expiring term has re-applied and no new
applications have been received.
Montana Code stipulates that BID Board members be owners of property within the district. In
the past, several applicants were appointed to the board as "property owner representatives"
because their property title named a corporation as the owner rather than the individual. For
many years the City Commission has honored this precedent by appointing property owner
representatives to the BID Board. At a date yet to be determined, the BID Board intends to re-
examine this practice and formally recommend to the City Commission whether or not to
continue this practice.
Created by Resolution No. 3361 and Ordinance No. 1517, per MCA 7-12-1121, on May 15,
2000, this district shall have duration of ten years. The board shall be comprised of not less than
five, nor more than seven, owners of property within the district. Three of the members who are
first appointed must be designated to serve for a one, two, or three-year term from the date of
their appointments and two must be designated to serve for a four-year term from the date of
their appointments. After initial appointment, members must be reappointed for a four-year
term.
The BID currently has one term expiring and one re-applying applicant.

Re: Downtown BID Board Appointment

RECOMMENDATION: On behalf of the BID Board, I would like to recommend re-appointing
Eric Bowman to the position on the Downtown BID Board. Mr. Bowman is an owner of
downtown property at 36 East Main Street.
BACKGROUND: As required by Montana Code, the Downtown Business
Improvement District (BID) Board shall be comprised of not less than five, nor more than seven,
owners of property within the district.
EFFECTS: This action would fill the vacancy created by the expiration of Mr.
Bowman for a term to expire in June of 2013. The appointment of Mr. Bowman will fill the only
vacant seat on this seven person board.
