BACKGROUND: The Planning Board (PB) is an advisory board who participates in the review of subdivision proposals in Bozeman. They are also charged with preparing a growth policy for the community. Their area of subdivision review is specified in ordinance. They also can participate in other planning activities relating to their purposes as described below. They have no final approval authority but make recommendations only. The PB uses the standards of the Unified Development Ordinance, especially Chapter 6, and the growth policy (Bozeman Community Plan) as the criteria upon which they base their review. All the identified documents are available through the Planning Department website. A Planning Board is charged with certain duties in Montana law, see below. 76-1-102. Purpose. (1) It is the object of this chapter to encourage local units of government to improve the present health, safety, convenience, and welfare of their citizens and to plan for the future development of their communities to the end that highway systems be carefully planned; that new community centers grow only with adequate highway, utility, health, educational, and recreational facilities; that the needs of agriculture, industry, and business be recognized in future growth; that residential areas provide healthy surroundings for family life; and that the growth of the community be commensurate with and promotive of the efficient and economical use of public funds. (2) In accomplishing this objective, it is the intent of this chapter that the planning board shall serve in an advisory capacity to presently established boards and officials. Locally the Planning Board is established in ordinance as follows: Chapter 2.66 CITY PLANNING BOARD 2.66.010 Established--Powers and duties. 2.66.020 Jurisdiction. 2.66.030 Composition. 2.66.010 Established--Powers and duties. Pursuant to and under the provisions of Title 76, Montana Code Annotated (MCA 76-1-101 et seq.), the city commission of the city does create and establish a city planning board to be known as the "Bozeman planning board" as provided in said title, and does by this chapter adopt all of the sections of the laws of Montana aforementioned that specifically pertain to a city planning board, granting and delegating to the city planning board all of the rights, privileges, powers, duties and responsibilities thereto appertaining. 2.66.020 Jurisdiction. The Bozeman planning board shall have such jurisdiction as provided by state law. 2.66.030 Composition. The Bozeman Planning Board shall consist of nine members, appointed to two year terms to expire on January 31, as follows: A. One member appointed by the City Commission from its own membership. The term of the appointed member shall be coextensive with the term of office to which he or she has been elected or appointed unless the Commission, on its first regular meeting of each year, appoints another to serve as its representative or unless the appointee's Commission term is terminated; B. Three members appointed by the City Commission one of whom, at the Commission's discretion, may be an employee of the City of Bozeman or hold public office in Bozeman or Gallatin County. The appointments shall be for two-year terms, with those terms to expire on January 31 of odd-numbered years; C. One member appointed by the Mayor, upon designation by the Gallatin County Board of Commissioners, who may be a member of the Board of County Commissioners or an office holder or employee of the County. This appointment shall expire on January 31 of odd numbered years; D. Four citizen members appointed by the Mayor, who shall be resident freeholders within the city limits, and who shall be qualified by knowledge and experience in matters pertaining to the development of the city. These appointments shall be coterminous with the term of the Mayor. The City Clerk shall certify the members appointed by the City Commission. The certificates shall be sent to and become a part of the records of the Bozeman Planning Board. The Mayor shall make similar certification for the appointment of citizen members.
