SUBJECT: Bozeman Peaks Condominiums Public Access Easement #Z-06079A
MEETING DATE: June 7, 2010
AGENDA MEETING ITEM: Consent
RECOMMENDATION: That the City Commission authorizes the City Manager to sign the attached
easement document.
BACKGROUND: The Human Resources Development Council (HRDC) brought forth a request to
provide “parkland equivalent” area on site in lieu of dedicated parkland for a residential site plan
development known as the Bozeman Peaks Condominiums. This request was reviewed by the Commission
at their April 19, 2010 meeting. The request was supported unanimously with the condition that a public
access easement be provided for the parkland equivalent area. The HRDC has submitted the required public
access easement for the “parkland equivalent” area to satisfy the required condition. Planning staff have
reviewed the document and have found it to be acceptable.
UNRESOLVED ISSUES: None determined at this time.
FISCAL EFFECTS: None determined at this time. The City will have no additional maintenance
responsibility for this parkland equivalent area. All maintenance will be the responsibility of the
Condominium Owner’s Association.
ALTERNATIVES: 1) Authorize the City Manager to sign the public access easement as recommended
above by Staff.
2) Recommend changes to the easement language prior to City Manager
signature.
3) Do not authorize City Manager signature on the public access easement.
