PROJECT: City of Bozeman 2010 Street Improvements
CONTRACT FOR: Cold milling and hot mix overlays, pavement marking replacements, and
seat coat improvements.
You are notified that your Bid dated May 25, 2010, for the above Contract has been considered.
You are the apparent Successful Bidder and have been awarded a Contract for cold milling and
hot mix overlays, pavement marking replacerrents, and seal coat improvements.
The Contract Price of your Contract is: three hundred eighty five thousand four hundred forty
seven and 60/100 Dollars 385,447.60).
Three copies of the proposed Contract Documents accompany this Notice of Award.
You must comply with the following conditions precedent within fifteen (15) days of the date
of this Notice of Award, that is, by

You must deliver to the OWNER 3 fully executed counterparts of the Agreement including
all the Contract Documents and Drawings.
You must deliver with the executed Agreement the Contract Security (Bonds) as specified in
the Instruction to Bidders (page 8), General Conditions (paragraph 5.01) and Supplementary
Conditions (paragraph SC-5.02).
List other conditions precedent:
You must deliver with the executed Agreement the Certificates of Insurance as specified in
the General Conditions (paragraph 5.03).
Failure to comply with these conditions within the time specified will entitle OWNER to
consider your Bid abandoned, to annul this Notice of Award, and to declare your Bid Security
forfeited.
VVithin ten (10) days after you comply with these conditions, OWNER will return to you one
fully signed counterpart of the Agreement with the Contract Documents attached.

AGENDA ITEM TYPE: Consent
RECOMMENDATION: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2010 Street Improvements to Knife River, Inc. in the amount of $385,447.60.
BACKGROUND: Bids were opened May 25, 2010, for the 2010 Street Improvements
project. The project consists of cold milling and asphalt overlays, chip seal improvements, and
pavement marking replacements at locations shown on the attached Work Vicinity Map. Two
bids were received, with the low bidder being Knife River, Inc. of Belgrade, MT in the amount
of $385,447.60. The bids appear to be competitive with the low bid being approximately 6%
below the construction estimate ($409,751.00). A copy of the Certified Bid Tabulation is
attached.
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Funding for this work has been planned for from the Fuel Tax
fund.
