ORDINANCE NO. 1433
AN EMERGENCY ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF BOZEMAN, MONT ANA, CHANGING THE EFFECTIVE DATE OF
ORDINANCE NO. 1428, REVISING THE PENAL TIES FOR OVERTIME
PARKING VIOLATIONS, FROM NOVEMBER 3, 1996, TO JANUARY 1,
1997.
PREAMBLE
. The purpose of this ordinance is to revise the effective date for
implementation of an escalating scale of overtime parking penalties.
Additional technical tasks incurred in setting up communications have
delayed the implementation of the handheld ticket writer system upon
which the new penalty schedule is based. This extension is necessary to
maintain the existing penalties until the new penalty schedule can be
implemented.
WHEREAS, the City Commission did, on the 16th day of September, adopt
Ordinance No. 1428, revising the structure for penalties for violations of the overtime
parking provisions contained in the Bozeman Municipal Code; and
WHEREAS, the revised structure provides for a graduated fee structure, with that
structure to be implemented in conjunction with the new handheld ticket writer system; and
WHEREAS, the new handheld ticket writer system will not be operational until
January 1, 1997; and
. WHEREAS, without the handheld ticket writer system, the City has no adequate
record keeping system in place to implement the new graduated fee structure.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of
Bozeman, Montana, that the effective date for the revisions to Section 10.32.410 of the
Bozeman Municipal Code, as adopted under Ordinance No. 1428, is hereby changed to
January 1, 1997.
Section 2
Repealer.
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts
thereof in conflict herewith are hereby repealed.
. Section 3
Severability.
If any provisions of this ordinance or the application thereof to any person or
circumstances is held invalid, such invalidity shall not affect the other provisions of this
ordinance which may be given effect without the invalid provision or application and, to this
end, the provisions of this ordinance are declared to be severable.

Section 4
Savings Provision.
This ordinance does not affect the rights or duties that matured, penalties and
assessments that were incurred or proceedings that begun before the effective date of this
ordinance.
. Section 5
Effective Date.
This ordinance shall be in full force and effect immediately.
PASSED, ADOPTED AND APPROVED by the City Commission of the City of
Bozeman, Montana, on first reading at a regular session thereof held on the 21st day of
October 1996.
