ORDINANCE NO. 1432
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE
BE
AMENDED BY ADDING SECTIONS TO BE NUMBERED SECTION 2.76.220
AND SECTION 2.76.230 OF SAID CODE; PROVIDING FOR PROHIBITION OF
DOGS IN THE SUNSET HILLS CEMETERY AND A MINIMUM FINE FOR
VIOLATIONS OF CHAPTER 2.76.
BE IT ORDAINED by the City Commission of the City of Bozeman, Montana, that
. Section 1
That the Bozeman Municipal Code be amended by adding a section to be numbered
Section 2.76.220, which section shall read as follows:
"2.76.220 Doas Prohibited.
It is unlawful for any person to release, cause, permit or bring a dog into the Sunset
Hills Cemetery, unless prior approval is obtained from the Cemetery Superintendent or designee
and the dog is part of a funeral procession or was owned by the deceased or the immediate
family of the deceased. The Cemetery Superintendent or designee may impose reasonable
conditions upon his or her approval."
Section 2
That the Bozeman Municipal Code be amended by adding a section to be numbered
. Section 2.76.230, which section shall read as follows:

"2.76.230 Penalties for Violations.
A. It is a misdemeanor for any person to violate any of the provisions of
this chapter.
8. Every person convicted of a misdemeanor for a violation of any of the
provisions of this chapter shall be punished by a fine of not less than five
dollars or more than five hundred dollars with the following exceptions:
1 . The minimum fine for violation of Sections 2.76.190,
2.76.210 and 2.76.220 shall be one hundred dollars;
2. Violations of Section 2.76.190 shall be punishable by
a fine not exceeding five hundred dollars, or by imprisonment
not exceeding six months, or both.
. C. Upon conviction, the court costs shall be assessed against the
violator. "
Section 3
Repealer.
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts
thereof in conflict herewith are hereby repealed.

Section 4
Severability.
If any provisions of this ordinance or the application thereof to any person or
circumstances is held invalid, such invalidity shall not affect the other provisions of this
ordinance which may be given effect without the invalid provision or application and, to this end,
. the provisions of this ordinance are declared to be severable.
Section 5
Savings Provision.
This ordinance does not affect the rights or duties that matured, penalties and
assessments that were incurred or proceedings that were begun before the effective date of this
ordinance.
Section 6
Effective Date.
This ordinance shall be in full force and effect thirty days after final adoption.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading at
a regular session thereof held on the 7th day of October 1996.
