ORDINANCE NO. 1428
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA. PROVIDING THAT THE BOZEMAN MUNICIPAL
CODE BE
AMENDED BY REVISING SECTION 10.32.410 OF SAID CODE; PROVIDING
FOR INCREASED FINES FOR OVERTIME PARKING VIOLATIONS.
BE IT ORDAINED by the City Commission of the City of Bozeman, Montana, that
. Section 1
That Section 10.32.410 of the Bozeman Municipal Code be amended so that such
section shall read as follows:
"10.32.410 Enforcement .- Penaltv for violations.
A. It is a misdemeanor for any person to violate any of the provisions of this
chapter.
B. Every person convicted of a misdemeanor for a violation of any of the
provisions of this chapter shall be punished by a fine of not less than five
dollars or more than #tfeef:n~g hundred dollars with the following exceptions:
1 . The minimum fine for overtime parking in violation of #\e

3. The minimum fine for violation of the following provisions
shall be fifteen dollars:
a. Section 1 0.32.030(A)(1) through (6), inclusive;
b. Section 1 O.32.030(A)(1 0);
c. Section 10.32.180;
d. Section 10.32.190.
4. Violation of Sections 10.32.390B through 0, inclusive,
shall be punishable by a fine not exceeding five hundred
dollars or imprisonment not exceeding six months or both.
C. Upon conviction, the court costs or any part thereof may be assessed against
the violator in the discretion of the court."
Section 2
. Repealer.
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts
thereof in conflict herewith are hereby repealed.
Section 3
Severability.
If any provisions of this ordinance or the application thereof to any person or
circumstances is held invalid, such invalidity shall not affect the other provisions of this
ordinance which may be given effect without the invalid provision or application and, to this end,
the provisions of this ordinance are declared to be severable.
Section 4
Savings Provision.
. This ordinance does not affect the rights or duties that matured, penalties and
assessments that were incurred or proceedings that begun before the effective date of this
ordinance.
Section 5
Effective Date.
This ordinance shall be in full force and effect as of November 3, 1996.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading at
a regular session thereof held on the 3rd day of September 1996.
