HomeMy WebLinkAboutOrdinance 96- 1426 Rezone (18) ORDINANCE NO. 1426 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT DESIGNA TIONS BY AMENDING THE ZONING DESIGNATION FROM "AS" (AGRICULTURAL SUBURBAN) TO "B.1" (NEIGHBORHOOD SERVICE) ON 8.37 ACRES LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF GOOCH HILL ROAD AND U.S. HIGHWAY 191. . WHEREAS. the proposed zone map amendment has been properly submitted. reviewed and advertised; and WHEREAS, the City-County Planning Board held a public hearing on April 2, 1996, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City-County Planning Board forwarded to the City Commission an unofficial recommendation for denial. on a 5 to 4 vote, regarding the requested zone map amendment; and WHEREAS, after proper notice, the City Commission held its public hearing on April 15, 1996, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment to be in compliance with the twelve criteria; and . WHEREAS. at its meeting held on April 15, 1996. the City Commission found that the proposed zone map amendment would be in compliance with the Bozeman Area Master Plan and would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby amended from" AS" (Agricultural Suburban) to "B-1" (Neighborhood Service): An 8.37-acre tract of land described as the East one-half of the Northeast one- quarter of the Northeast one-quarter of the Northeast one-quarter, and the East one-half of the Southwest one-quarter of the Northeast one-quarter of the Northeast one-quarter, and the Northeast one-quarter of the Southeast one- . quarter of the Northeast one-quarter of the Northeast one-quarter, and the East one-half of the Northwest one-quarter of the Southeast one-quarter of the Northeast one-quarter of the Northeast one-quarter, of Section 17, Township 2 South, Range 5 East, Montana Principal Meridian, Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana (according to Dependent Survey #17). EXCEPTING THEREFROM: those premises conveyed to the State of Montana as disclosed by Bargain and Sale Deed, recorded April 27, 1956 in Book 120 of Deeds, page 571, and Bargain and Sale Deed recorded June 9, 1994 in Film 145, page 225. -----.,.- Section 2 This ordinance shall be in full force and effect thirty (30) days after final adoption on second reading.
