SUBJECT: Approval of Change Order #8 for the Lower Yard Vehicle Maintenance
and HRDC Bus Barn to revise the foundation sub-grade preparation, (CP#03); Replace the fill in
the old clarifiers due to wet conditions, (CP#04); Add additional conduit under the slab for
phone and data service, (CP#21).

RECOMMENDATION: Authorize the City Manger to sign Change Order #8 for the Lower
Yard Vehicle Maintenance and HRDC Bus Barn to revise the foundation sub-grade preparation,
(CP#03); Replace the fill in the old clarifiers due to wet conditions, (CP#04); Add additional
conduit under the slab for phone and data service, (CP#21), for a total of $4,897.27 for the city.
BACKGROUND: The site of the Lower Yard Vehicle Maintenance Building and HRDC Bus
Barn is where the old city waste water treatment plant was located. When the operation was
abandoned a good deal of the plant infrastructure was left in place. The locations of the known
equipment were incorporated into the existing site condition pages on the bid and construction
documents.
Prior to bidding there was some site investigation done by the engineers to assess the types and
condition of the soils on the site. The test pits that were dug showed diverse soil conditions and
a variety of soil layers that confirmed a good deal of past site disturbance.
Once the excavation for the footing and foundation was complete, an assessment of the sub-base
showed quite a degree of inconsistency. The sub-grade preparation in CB#03 includes the
importation of fill material and the addition of Geogrid Fabric to establish a solid solid sub-base
for the building. Cost for this material and installation for the city is $2,531.38.
The large concrete clarifier tanks from the old plant are still buried on the site. During
excavation the accumulate groundwater was pumped from the tanks. In the areas on site where
the tanks are located under areas were stable soils are necessary the material in the tanks was

replaced with the appropriate they of fill that can be compacted, CP#04. Cost for this work for
the city is $2,200.00.
The phone and data systems for the building will be separated because the city has its own phone
system and HRDC will need to be connected to Qwest for its phone system. The city is served
from Bresnan for its phone and data connection. During the site visit with the utilities we
discussed service lines into the building.
The original plans show a 2 inch conduit running under the building slab from the termination
box on the exterior of the building to the IT closet. The utilities have requested that there be
separate conduits for each of the services entering the building to avoid problems in service
down the road. The solution involves the installation of a second parallel conduit so that the
services can be segregated. CP#18 is for the material and installation of the conduit for the city
is $165.89.
UNRESOLVED ISSUES: The original change request included consideration of some
weather days and a contract extension for the removal of the asbestos containing materials. This
approval has been removed from this change and will be dealt with separately. No others related
to this proposed Change Order.
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: The modifications to the work area are owner initiated changes and
would be covered in the 12% Project Contingency. Activity to date under the contingency
includes:

COMMISSION RESOLUTION NO. 4258
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, APPROVING ALTERATION/MODIFICATION OF
CONTRACT WITH BN BUILDERS, BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 5th day of October 2009, authorize award of the
bid for the Construction of the Vehicle Maintenance Building and HRDC Bus Barn to BN Builders,
Bozeman, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman,
a municipal corporation, and BN Builders, Bozeman, Montana, as contained in Change Order #8, attached
hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to
execute the contract change order for and on behalf of the City; and the City Clerk is authorized and
directed to attest such signature.
