ORDINANCE NO. 1423
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT
DESIGNATIONS BY AMENDING THE ZONING DESIGNATION FROM "PU"
(PUBUC LANDS AND INSTITUTIONS) TO "BP" (BUSINESS PARK) ON 18.293
ACRES LOCATED IN THE NORTHWEST ONE-QUARTER OF SECTION 14,
TOWNSHIP 2 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN.
. WHEREAS, the proposed zone map amendment has been properly submitted, reviewed
and advertised; and
WHEREAS, the City-County Planning Board held a public hearing on November 7, 1995,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City-County Planning Boa rd recommended to the Bozeman
City
Commission that the requested zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on November
20, 1995, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment
to be in compliance with the twelve criteria; and
. WHEREAS, at its meeting held on November 20, 1995, the City Commission found that
the proposed zone map amendment would be in compliance with the Bozeman Area Master Plan \
and would be in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby amended
from "PU"(Public Lands and Institutions) to "BP" (Business Park):
A 17.599-acre portion of Tract A-1-A-2 of Certificate of Survey No. 1243C,
located in the Northwest one-quarter of Section 14, Township 2 South, Range
5 East, Montana Principal Meridian, which is on file and of record in the Office
of the Clerk and Recorder, Gallatin County, Montana. Said tract is more
. particularly described as follows:
Beginning at a point which bears South 00010'01" West a distance of 70.00
feet from the North one-quarter corner of said Section 14. Thence along the
Easterly line of said Tract A-1-A-2, through the following courses:
South 00010'01" West a distance of 260.00 feet
South 75040'31" West a distance of 471.76 feet
South 81053'33" West a distance of 508.58 feet
South 73023'41" West a distance of 129.32 feet
South 00007'39" West a distance of 781.47 feet

Thence South 89053'58" West along the South line of said Tract A-1-A-2, a
distance of 262.57 feet. Thence North 00007'02" East along the West line of
the Northeast one-Quarter of the said Northwest one-Quarter of Section 14, a
distance of 1287.58 feet. Thence along the Southerly right-of-way of State
Highway (Deed on Film 153, Pages 2732-2736) along a 2381.83 foot radius
curve to the left with a radial bearing of North 12017'25" West, through a
central angle of 04013'42" for an arc length of 175.77 feet. Thence along the
North line of said Tract A-1-A-2 through the following courses:
e North 89042'23" East a distance of 276.96 feet
South 00017'37" East a distance of 70.00 feet
North 89042'23" East a distance of 899.44 feet to the point
of beginning.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at a
regular session thereof held on the 20th day of May 1996.
