ORDINANCE NO. 1422
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT
DESIGNATIONS BY AMENDING THE ZONING DESIGNATION FROM "R.3"
(RESIDENTIAL--MEDIUM-DENSITY) AND "R.4" (RESIDENTIAL--HIGH.DENSITY)
TO "R.MH" (RESIDENTIALnSINGLE.FAMIL Y MOBILE HOME) ON 20.0 ACRES
LOCATED IN THE EAST ONE-HALF OF THE NORTHEAST ONE-QUARTER OF
. THE SOUTHWEST ONE.QUARTER OF SECTION 11, TOWNSHIP 2 SOUTH,
RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN.
WHEREAS, the Bozeman City.County Planning Board held a public hearing on October 3,
1995 on Zoning Application No. Z.95117 to amend the zone map designation from "R.3" and "R-4"
to "R-MH". and recommended to the City Commission on a 7-0 vote to approve the zone map
change; and
WHEREAS. the City Commission held its public hearing on October 23, 1995 and found
that the proposed zone map amendment to be in compliance with the twelve criteria established
in Section 76-2-304, M.C.A.; and
WHEREAS, the applicant. in a letter dated February 23. 1996, requested additional
hearings on this request due to the applicant providing an incomplete mailing list of adjoining
. property owners within 200 feet of the subject property; and
WHEREAS, the rehearings were considered under renumbered Applica~ion No. Z-9622; and
WHEREAS, the City-County Planning Board held a public hearing on April 16. 1996. to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS. the City-County Planning Board forwarded no formal recommendation to the
Bozeman City Commission regarding the requested zone map amendment; and
WHEREAS. a protest against such change was signed by the owners of 20 percent or
more either of the area of the lots included in such proposed change or of those immediately
adjacent in the rear thereof extending 150 feet therefrom or of those adjacent on either side thereof
within the same block or of those directly opposite thereof extending 150 feet from the street
frontage of such opposite lots; and
WHEREAS, the City Commission conducted its public hearing at the meeting held on May
. 6. 1996. to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS. the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304. M.C.A., and found the proposed zone map amendment
to be in compliance with the twelve criteria; and
WHEREAS. at its meeting held on May 6. 1996, the City Commission found that the

proposed zone map amendment would be in compliance with the Bozeman Area Master Plan and
would be in the public interest; and
WHEREAS, the proposed zone map amendment was passed by a favorable vote of four
of five members of the City Commission.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
. Montana:
Section 1
That the zoning district designation of the following-described property is hereby amended
from "R-3" (Residentialn M ed ium-density) and "R-4" (Residentialn
High-density) to "R-MH"
(ResidentialhSingle-family Mobile Home):
Tract 1 and Tract 2 of the Barrick Annexation, located in the East one-half of the
Northeast one-quarter of the Southwest one-quarter of Section 11, Township 2
South, Range 5 East, Montana Principal Meridian, and more commonly located
along the south side of the 2700 and 2800 blocks of West Babcock Street.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at a
. regular session thereof held on the 20th day of May 1 996.
