ZONING COMMISSION MINUTES
TUESDAY, APRIL 20, 2010
ITEM 1. CALL TO ORDER AND ATTENDANCE
Vice Chairperson Minnick called the meeting to order at 7:02 p.m. and ordered the Recording
Secretary to take attendance.

ITEM 2. PUBLIC COMMENT (0-15 MINUTES)

scheduled on this agenda. Three-minute time limit per speaker.}
Seeing there was no public comment forthcoming, Vice Chairperson Minnick closed this portion
of the meeting.
ITEM 3. MINUTES OF FEBRUARY 17, 2010
Mr. Lieb stated he had not been reappointed as a member at the last meeting and so was not
absent.
MOTION
: Mr. Sypinski moved, Mr. Lieb seconded, to approve the minutes of February 17,
2010 as amended. The motion carried 3-0. Those voting aye being Mr. Lieb, Mr. Sypinski, and
Vice Chairperson Minnick. Those voting nay being none.
Vice Chairperson Minnick suggested Items 4 and 5 be reversed in order. The Commission
concurred.

ITEM 5. PROJECT REVIEW
1. Zone Map Amendment Application #Z-10037 – (
Williams Industrial Park) A
Zone Map Amendment requested by the applicant and owner, Powder River
Company, LLC, and representative, Jason Leep, and requesting to establish an
urban zoning designation of M-2 (Manufacturing and Industrial District) on 4.254
acres in conjunction with annexation for property legally described as Tract 20,
Gordon Mandeville State School Section Subdivision, Gallatin County, Montana
and generally located on Maus Lane. (Krueger)
Associate Planner Brian Krueger presented the Staff Report noting the project was approximately
4 ¼ acres in size. He directed the Commission to the aerial photo of the property and noted there
was current county road as a portion connecting Maus Lane and Leah Avenue. He stated the
proposal was in conjunction with an annexation application as was common practice. He stated
there were a few pockets of County property adjacent to the site and the City was slowly filling in
that area. He stated the current uses on site were industrial storage yards with a few buildings on
site. He noted there was a difference in topography on the site and directed the Commission to
photographs of what existed on adjacent properties. He stated the current Growth Policy
Designation was Industrial and noted those designations in the vicinity of the parcel. He noted
zoning designations on surrounding properties. He stated the property was one of the primary
locations for industrial property in the City and the site was a designated appropriate location for
that type of development. He stated no public comment had been received after noticing of the
proposal through appropriate measures. He stated Staff was supportive of the proposal with
three contingencies that were the base contingencies any applicant would receive with a Zone
Map Amendment Application. He stated the minutes would be forwarded to the City
Commission for their scheduled review date.
Mr. Lieb asked the difference between M-1 and M-2 zoning. Planner Krueger responded there
were differences in the use table for M-2 zoning that would allow heavier industrial uses than the
M-1 district; as an example M-1 allowed office uses for the entire property where M-2 allowed
only partial offices in addition to a heavier industrial use. He stated the M-2 zoning would allow a
higher intensity use.
Mr. Sypinski asked where the City was in the annexation process for the proposal. Planner
Krueger responded the annexation had run concurrently through the review process and Staff was
supportive of the proposal with conditions. Mr. Sypinski stated he appreciated that the
application had been moved forward expediently.
Jason Leep addressed the Zoning Commission. He stated he had nothing to add to Planner
Krueger’s presentation and that he was available to answer questions.
Mr. Lieb asked what Powder River, LLC was. Mr. Leep responded it was just an LLC that
owned property in the City. Mr. Lieb asked if they were an industrial company. Mr. Leeb
responded they were not an industrial entity and had no intention of doing manufacturing on the
property themselves.

Mr. Sypinski asked how subdivision would occur in the M-1 zoning designation. Mr. Leeb
responded the applicant would go through standard subdivision review processes.
There were no members of the public in attendance for the public comment period.
Vice Chairperson Lieb stated he felt the application was in keeping with the review criteria of the
UDO and he was in favor of the application with Staff conditions of approval.
Mr. Sypinski stated he concurred with Vice Chairperson Sypinski that the twelve review criteria
had been met. Mr. Lieb concurred.
MOTION
: Mr. Sypinski moved, Mr. Lieb seconded, to forward a recommendation of approval
to the City Commission for Zone Code Amendment Application #Z-10037. The motion carried
3-0. Those voting aye being Mr. Lieb, Mr. Sypinski, and Vice Chairperson Minnick. Those
voting nay being none.
ITEM 4. ELECTION OF OFFICERS
MOTION
: Mr. Sypinski moved, Mr. Lieb seconded, to nominate the current slate of officers for
the next year. The motion carried 3-0. Those voting aye being Mr. Lieb, Mr. Sypinski, and Vice
Chairperson Minnick. Those voting nay being none.
ITEM 6. NEW BUSINESS
Mr. Lieb addressed the public to encourage them to volunteer for the vacancy on the Zoning
Commission.
Mr. Sypinski suggested anyone who knew someone who might be interested initiate contact with
that individual.
ITEM 7. ADJOURNMENT
The Zoning Commission meeting was adjourned at 7:17 p.m.
