HomeMy WebLinkAboutOrdinance 98- 1456 Rezone (26) -- ORDINANCE NO. 1456 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT DESIGNATIONS BY ESTABLISHING AN INITIAL ZONING DESIGNATION OF "R-2A" (RESIDENTIAl--SINGlE-FAMll Y. MEDIUM-DENSITY) ON APPROXIMA TEL Y 148.05 ACRES lOCATED IN THE SOUTHWEST ONE~ QUARTER. SECTION 2, TOWNSHIP 2 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN. . WHEREAS, the proposed zone map amendment to establish an initial zoning designation of "R-2A", Residential~~Single-family, Medium-density, has been properly submitted, reviewed and advertised; and WHEREAS, the City-County Planning Board held a public hearing on July 1, 1997, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City-County Planning Board recommended to the Bozeman City Commission that the zone map amendment to establish an initial zoning designation of "R-2A", Residential--Single-family, Medium-density, be approved; and WHEREAS, after proper notice, the City Commission opened its public hearing on July 21 , 1997; and WHREAS, the Commission reopened and conducted its public hearing on August 11, . 1997, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on August 11, 1997, the City Commission found that the proposed zone map amendment would be in compliance with the 1990 Bozeman Area Master Plan Update and would be in the public interest upon amendment of the Master Plan and annexation of the subject parcel; and WHEREAS, the subject parcel was annexed through adoption of Commission Resolution No. 3217, adopted on the 1 st day of December 1997; and . WHEREAS, the 1990 Bozeman Area Master Plan Update was amended through adoption of Commission Resolution No. 3220, adopted on the 15th day of December 1997 to establish an initial land use designation of "Urban Residential Infill" on the subject parcel. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: ---.-.--.-.. --.----.- Section 1 That the initial zoning district designation of the following-described property is hereby established as "R-2A" (Residential--Single~family, Medium-density): A 148.05-acre tract of land known as the Southwest one~quarter of Section 2, Township 2 South, Range 5 East, excepting therefrom the West one-half of the West one-half of the Northwest one-quarter of the Southwest one-quarter and . the West one-half of the West one-half of the Southwest one-quarter of the Southwest one-quarter, Montana Principal Meridian, Gallatin County, Montana. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading.
