Present were y Becker, Commissioner Chris Mehl, Commissioner Carson Taylor, Interim Planning Director Chris Saunders, Staff Attorney Tim Cooper and Deputy City Clerk Aimee Kissel. Call meeting to Order noon to 1:30 p.m., Commission room, City Hall, 121 North Rouse 0:00:06 B. Pledge of Allegiance and Moment of Silence 0:00:54 Mayor Krauss Mayor Krauss welcomed everyone to the meeting saying policy meetings are designed to enable a dialogue between the staff and City Commission. 0:01:46 C. Round Table Discussion Mayor Krauss explained that the round table discussion is available for Commissioners to speak regarding anything that was bothering them from a prior meeting to either place it on an upcoming agenda or talk with staff about it briefly. 0:02:25 Mayor Krauss Mayor Krauss asked if anyone had any round table items. Discussion with the Montana Department of Revenue Liquor Licensing Division regarding Liquor /Gaming Licenses (Saunders) 0:02:58 John Flynn, Bureau Chief for Liquor Licensing, Liquor Control Division, Montana Department of Revenue Mr. Flynn introduced Marilyn Christensen, Compliance specialist who handles Gallatin County, Belgrade, Bozeman and West Yellowstone, for the Department of Revenue. 0:04:12 Marilyn Christensen, Compliance specialist Ms. Christensen explained the process the division uses for an on- premises consumption liquor license application iterating there are many kinds of on premise licenses and a variety of rules and zoning for each. She spoke briefly regarding the quota system and explained that Bozeman and Belgrade have been combined into one quota area. 0:09:42 Mayor Krauss Mayor Krauss confirmed with staff that a new or transferred in liquor license triggers the need for a conditional use permit per a City of Bozeman Ordinance. 0:10:23 Ms. Christensen Ms. Christensen explained the meaning of the numbers on a state liquor license and the restrictions related to each suffix type. She then explained the quota system the state uses to determine the number of liquor licenses allowed in an area. 0:16:56 Ms. Christensen Ms. Christensen responding to a question from Mayor Krauss, explained the system regarding over quota licenses. 0:25:00 Ms. Christensen Ms. Christensen explained the meaning of the numbers on a state liquor license and the restrictions related to each suffix type. She then explained the quota system the state uses to determine the number of liquor licenses allowed in an area, how floater licenses work and how census population numbers are used to determine license numbers. Mehl asked about the status of the liquor license for the Rocking R Bar since the explosion that destroyed it. 0:28:57 Ms. Christensen Ms. Christensen explained that the Rocking R Bar is on non -use status and because of extenuating circumstances the department will continue to work with them. She provided contact information for the liquor license division and spoke regarding related resources. 0:41:46 Mayor Krauss Mayor Krauss thanked Ms. Christensen and Mr. Flynn for coming to Bozeman to discuss these concerns. 0:42:56 Ms. Christensen Ms. Christensen answered a question from Cr. Becker regarding quotas. 0:43:25 Ms. Christensen Ms. Christensen explained that the division publishes quota information after receiving census numbers in early August through a legal publication in the newspaper if the area is to receive additional licenses. 0:44:36 Ms. Christensen Ms. Christensen explained that since the area is seven licenses over already those will have to be absorbed by an increased population before any new licenses will be issued based on increased population. 0:45:05 Ms. Christensen Ms. Christensen explained the resort license determined area near Bozeman. 0:47:35 Ms. Christensen Ms. Christensen explained that the area is at par with beer and beer and wine licenses. Taylor began a discussion regarding enforcement issues. 1:04:10 Brian Kruejier, Associate Planner Mr. Krueger asked how the division confirms that a cabaret licensee is following the related regulations. 1:04:54 Mr. Flynn Mr. Flynn explained that once a license is issued, the division relies on the public and investigative staff. 1:06:03 Cr. Becker Cr. Becker began questions and discussion regarding incorporation and County license issues and how annexations affect licenses. 1:12:56 Cr. Taylor Cr. Taylor began questions and discussion regarding the Bozeman, Belgrade connection. 1:16:12 Ms. Christensen Ms. Christensen responding to a question from Cr. Mehl explained that cabaret beer and wine licenses cannot ever have gambling. 1:16:23 Ms. Christensen Ms. Christensen explained when licenses can and cannot have gambling. 1:18:06 John Henderson, GIS Mr. Henderson explained how mapping of licenses is handled by the City GIS department. 1:18:55 F. FYI 1:18:57 1. Funeral and procession for U.S. Marine Corps Corporal Nicholas Uzenski. Mayor Krauss provided details regarding the funeral and procession tomorrow January 22nd for a local Marine who died in action. 1:19:33 G.
