The Commission of the City of Bozeman met in the Commission Room, City Hall at 121 North
Rouse on Monday, February 16, 2010. Present were Mayor Jeff Krauss, Commissioner Cyndy
Andrus, Commissioner Sean Becker, Commissioner Chris Mehl, Commissioner Carson Taylor,
City Manager Chris Kukulski, Assistant City Manager Chuck Winn, Interim Planning Director
Chris Saunders, City Attorney Greg Sullivan, Finance Director Anna Rosenberry and City Clerk
Stacy Ulmen.

Mayor Krauss called the Regular Meeting to order.

Mayor Krauss asked City Manager Chris Kukulski if there were any changes to the Agenda.

Mr. Kukulski stated that there were not any changes to the agenda.

1. Authorize Payment of Claims (LaMeres)
2. Authorize City Attorney to Sign General Release for Settlement in the MMIA Suit to
Recover Damages in Bogert Pavilion Fire (MMIA/City of Bozeman v. White et al., Cause
No. DV-08-527C) (Sullivan)
3. Authorize the Mayor to sign Bozeman Construction Agreement for City-Maintained
Route for the Montana Department of Transportation for South Church Avenue & South
11th Avenue Projects (Hixson)
4. Approve Resolution No.4245 - A Resolution relating to $9,500,000 Sewer System
Revenue Bond (DNRC Water Pollution Control State Revolving Loan Program), Series
2010D; Authorizing the issuance and fixing the Terms and Conditions Thereof
(Rosenberry)
5. Approve Reclaiming the Final Approval of the F&H Building Conditional Use
Permit/Certificate of Appropriateness Application No. Z-10008, per Section 18.64.010
C.1 of the B.M.C., and further set a tentative public hearing date of March 8, 2010 for
formal consideration of the application proposal (Bristor)

It was moved by Cr. Mehl, seconded by Cr. Andrus to approve Consent Items G. 1-5.
Those voting Aye being Crs. Mehl, Andrus, Taylor, Becker and Mayor Krauss.
Those voting No being none.
The motion passed 5-0.

Mayor Krauss opened General public comment.
0:01:48 Lynda MCaine, Public Comment
Ms. MCaine of 3014 Colter Avenue introduced the group Citizens for Unleashed Dog Parks and
Trails.
0:02:30 Joan Ferraro, Public Comment
Ms. Ferraro of 3002 Colter Avenue spoke regarding off leash dog parks. She spoke regarding
ideal areas for off leash parks and trails. Sourdough and Sundance trails were mentioned. They
would like to continue using the trails for off leash use however the City has been enforcing the
leash law on those trails. The group urged the Commission to look into a City wide process for
off leash dog trails.

Ms. Bryan stated that she walks the trails and there is a lot of open space. In her experience,
those that need to have dogs on leashes do so.

Mr. Sadik of 3902 Rain Roper Dr. stated that 80-85% people use the trail. Most in the
neighborhood have dogs. The area has predominantly been used for dog exercise.

Ms. Ennis of 194 Bison Trail stated that she has been in Bozeman 11 years. She used to take her
dogs to the area. She urged the Commission to consider the trail leash free.

Ms. Platt of 144 Hitching Post Drive stated that she has observed responsible dog owners in the
area.

0:12:14 Anne Banks, Public Comment
Ms. Banks of 7 Hill Street stated that she sees her fellow neighbors almost every day. This is a
social activity. Our part of town needs an off leash park. She urged the Commission to consider
the public comment given tonight.
0:14:02 Carol Bilbone, Public Comment
Ms. Bilbone of 183 Lane stated that this is a matter of quality of life. She wants her kids to enjoy
walking the dogs. They don't because they don't want to get into trouble for not leashing the
dogs.

Mayor Krauss thanked the group for coming to speak. It takes the Mayor or three members of
the Commission to add an agenda item. Mayor Krauss spoke regarding the Parks Master Plan.

Mr. Fontenot spoke regarding the process of making parks off leash.

Mayor Krauss stated that there would need to be two revisions, one to the master plan and the
other to title 6.

0:28:45 1. Empire Building Materials Storage Building-Request for Modification of a
Previously Approved Variance No. C-10001 (request to Continue to February 22, 2010)

0:29:02 Motion and Vote to continue the Empire Building Materials Storage Building
request for modification to February 22, 2010.
It was moved by Cr. Andrus, seconded by Cr. Becker to continue the Empire Building
Materials Storage Building request for modification to February 22, 2010.
Those voting Aye being Crs. Andrus, Becker, Mehl, Taylor and Mayor Krauss.
Those voting No being none.
The motion passed 5-0.

0:29:27 J. FYI/Discussion
0:29:37 1. Washington DC Trip
Mayor Krauss explained that he did not get to go to Washington DC. Everything was shut down
due to weather. Cr. Mehl wondered if it should be discussed to send someone. A majority of the
Commission agreed that someone should go to DC to talk regarding federal appropriation
requests.
0:36:59 2. Planning Bus Tour of Commercial areas
Cr. Mehl suggested that a Tour be put together to observe the Commercial areas in Town. Cr.
Becker suggested that Rob Buckvich from MDT be invited. An April time will be considered.
0:41:17 3. Police Chief and Planning Director Interviews
It was confirmed that the Mayor is part of the interview team for the Planning Director and Cr.
Becker is part of the interview team for the Police Chief.
0:41:50 4. Interest Off-Leash trails (from Public Comment)
Cr. Taylor wondered if it should be suggested that the Parks and Recreation Department look
into the request of those that made public comment earlier in the meeting. A Dog Committee
report has been completed by a previous group. A copy of this will be forwarded to the
Commission. Discussion took place regarding leash laws. The Commission decided that they
will read the Dog Committee report before moving ahead on a decision regarding this item.
