Consent 1. Authorize Payment of Claims (LaMeres) 2. Authorize Mayor to sign a Memorandum of Understanding for Continuing Transportation Planning (Saunders) 3. Approve Cancelling the April 1, 2010 Policy Meeting and reschedule to April 8, 2010 and approve Cancelling the May 6, 2010 Policy Meeting and reschedule to May 20, 2010 (Ulmen) 4. Approve Resolution No. 4251, Relating to Financing of certain proposed projects; Establishing Compliance with Reimbursement Bond Regulations under the Internal Revenue Code (Rosenberry) 5. Approve a Professional Services Agreement with Renewable Technologies, Inc. to complete the Environmental Assessment for the Downtown Explosion Site in order to fulfill our Environmental Review requirements under the Housing and Urban Development (HUD)- Economic Development Initiative (EDI) Grant Program (Johnson) *Consider a motion approving Consent Items E. 1-5 as listed above. Update regarding an Off-site Indoor Air and Sub-slab Vapor Investigation (Arkell/Cooper/Jenifer S. Reece, Moore, O'Connell & Refling, P.C. and Mike Ellerd, ATC, Inc.) H. Action Items 1. Habitat for Humanity Affordable Housing Request (Rosenberry) *Consider a motion Approving funding of the Habitat for Humanity Affordable Housing request from either the Development Impacts Fund OR Community Housing Fund. 2. Caldwell Demolition and New Construction at 601 South Black Avenue, Sketch Plan Certificate of Appropriateness No. Z-10021 (Kramer) *Consider a motion Making the Findings required of Bozeman Municipal Code 18.28.080 to conditionally approve the Caldwell Demolition and New Construction at 601 South Black Avenue, Sketch Plan Certificate of Appropriateness Application No. Z- 10021. 3. Ordinance No. 1785, Revisions to Chapter 12.22 of the Bozeman Municipal Code, Downtown Sidewalk Encroachment Permit Program, to allow for Nonsubstantial, Substantial, and Exclusive Uses in Public Right- of-Way of the Downtown Business District (Bristor/Heaston) *Consider a motion Provisionally Adopting Ordinance No. 1785, amending Chapter 12.22 of the Bozeman Municipal Code, Downtown Sidewalk Encroachment Permit Program to allow for Nonsubstantial, Substantial, and Exclusive Uses in Public Right-of- Way of the Downtown Business District. 4. Public Hearing & Adoption of Parts of the Capital Improvements Program (CIP) for Fiscal Years 2011-2015 (Rosenberry) *Consider a motion approving the Building Inspection Fund within the Capital Improvements Program (CIP) for Fiscal Years 2011-2015. *Consider a motion approving the Fire Equipment and Capital Replacement within the Capital Improvements Program (CIP) for Fiscal Years 2011-2015. *Consider a motion approving the Tree Maintenance District (Forestry) within the Capital Improvements Program (CIP) for Fiscal Years 2011-2015. 5 Agenda of the Bozeman City Commission, March 29, 2010 3 5. Resolution No. 4250, Anti-Discrimination Policy for Contracts and Other Agreements and Purchases (Sullivan) *Consider a motion approving Resolution No. 4250, Anti-Discrimination Policy for Contracts and Other Agreements and Purchases. 6. Appointment to the Design Review Board (Kissel) *Consider a motion appointing one new member as the ‘non-professional’ representative on the Design Review Board. I. FYI/Discussion J.
