MEETING DATE: March 22, 2010 AGENDA ITEM TYPE: Action. RECOMMENDATION: Consider the draft Ordinance 1780 which incorporates Commission directed changes and decide whether to proceed with second reading and final adoption. BACKGROUND: The City Commission directed the preparation of amendments to the City’s sign regulation that would allow for a rotating barber pole sign. A public hearing was held by the Commission on March 1, 2010. The draft proposal would accommodate barber poles as well as other forms of rotating signs. The Commission passed the 1st reading of the ordinance and directed a change to the allowed size of the rotating sign to reduce the area to 2.5 square feet subject to confirmation of certain calculations by staff. Staff reviewed a sample of available sizes for barber poles. In the sample, the smallest model (Marvy 410) had a rotating element of 0.65 square feet and the largest model (Marvy 824) had a rotating element of 2.75 square feet. The overall size of all models in the sample would comply with the maximum size limitation for projecting signs. If the Commission desires to allow the largest size sign in the sample the allowed rotating area should be increased by .25 square feet. If the Commission wishes to retain the 2.5 square feet number desired sign types will still be permitted. The formula for calculating the rotating area of the sign is (D x pi x H)/2 where D is the diameter, pi is 3.14, and H is the height of the glass enclosing the rotating element. We divide by two in recognition that anyone approaching the sign can only see a maximum of 180 degrees of the surface of a curved object, see the last sentence in Section 18.80.210, Area of Signs, BMC. Effective date of the ordinance will be April 21, 2010 if 2nd reading approval occurs. FISCAL EFFECTS: No fiscal effects are known at this time. 213 ALTERNATIVES: 1) Approve 2nd reading of the ordinance as presented. 2) Make further revisions to the ordinance and then approve 2nd reading. 3) Do not approve 2nd reading of the ordinance.
