Kukulski, City Manager SUBJECT: Jurisdiction of Audrey’s Pizza Conditional Use Permit/Certificate of Appropriateness Application for Cabaret License and related improvements (#Z-10018) Final Approval MEETING DATE: March 22, 2010 AGENDA ITEM TYPE: Consent Item RECOMMENDATION: That the City Commission consider reclaiming to itself the final approval of the Audrey’s Pizza Conditional Use Permit/Certificate of Appropriateness Application for Cabaret Licensing, per Section 18.64.010 C.1 of the B.M.C., and further set a tentative public hearing date of April 12, 2010 for formal consideration of the application. BACKGROUND: On March 17, 2010, the applicant Steven Schlegel of Great Northwest Construction, Inc. verbally requested that the City Commission reclaim to itself the final approval of Audrey’s Pizza Conditional Use Permit/Certificate of Appropriateness (CUP/COA) application which includes a request for approval for a beer and wine cabaret license. The DRC voted unanimously for a favorable recommendation with staff conditions and code provisions to the final review authority; however, it’s staff’s understanding that the applicant may seek relief from some of the staff conditions and code provisions because of conditions unique to this redevelopment effort. This application was tentatively scheduled to be heard by the Board of Adjustment on April 13, 2010. The Commission may strike or amend staff project specific conditions but to strike or amend code provisions requires that the applicant request specific variances. Variance requests require a supplemental application which must be noticed, reviewed and acted upon at a public hearing. Variances should be reviewed and acted upon before review and action on the overall application. The City Commission public hearing date for this application is tentatively set for April 12, 2010. UNRESOLVED ISSUES: None identified. FISCAL IMPACTS: The standard application fee was received for the CUP/COA project and was added to the Department of Planning’s application fee revenue. Additional fees will likely be required for the variance application. ALTERNATIVES: As suggested by the City Commission. 51
