MEETING DATE: February, 2010 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign the contract to Watco Pools for construction of the Ultra- Violet disinfection system at the Bozeman Swim Center for $50,863.54., bid awarded on January 19 2010 by the commission. Equipment and Installation $40,983.54 Extended warranty $5,000.00 2 year maintenance contract $4,880.00 Total $50,863.54 BACKGROUND: The award of bid for the Ultra Violet filtration system at the Swim Center was approved by the Commission on January 19, 2010. The contract with the vendor was not complete at the time of award and the legal department had not completed their review of the contract document. Staff has now received signed copies of the contract from the vendor and the legal department has approved the content. A copy of the bid award Memo from January 19, is attached so that you are clear on previous action taken on the project. FISCAL EFFECTS: This project was an approved CIP item for the FY 2010. ALTERNATIVES: As suggested by the City Commission. Attachments: Contract January 19, Commission Memo on bid award Report compiled on: February 4, 2010 CONTRACTOR AGREEMENT IN CONSIDERATION of the covenants and conditions hereafter expressed in this Agreement, made the 'K' day of 20/6 between City of Bozeman (Owner) and BKM Enterprises, Inc dba Watco Pogis (Contrakr) of 308 Moore Lane, Billings, MT 59101. SS# or Federal Tax ID 20- 4586718 For the following project: Installation of UV Disinfection System for Bozeman Swim Center GUARANTEES: Contractor agrees to guarantee all materials and workmanship for a period of not less than one (1) year after the date of possession is transferred from Contractor to Owner. Contractor agrees to provide service on all projects in which they provided the original material and /or labor. Correction of defective material or faulty workmanship shall be at the Contractor's sole expense. INSPECTION: It is the Contractor's responsibility to obtain any and all permits and inspection for their work. GENERAL: 1. Material and workmanship provided by contractor shall meet the codes and requirements of all appropriate governmental authorities. 2. Contractor shall maintain and provide the Owner with certificates of insurance verifying the following: a. Montana Contractors Registration b. Contractors Workers' Compensation certificate c. Contractors Public General Liability with the following limits and/or endorsements. $1,000,000 Each Occurrence (Bodily Injury Property Damage) $2,000,000 General Aggregate $2,000,000 Products /Completed Operation Aggregate $1,000,000 Per Person or Organization (Personal Advertising Injury) 3. Certificates of Insurance must be presented to the Owner, naming the Owner as a additional insured before payment is made on work performed. General Liability Certificates shall have a 30 -day notice of cancellation and Workers Compensation Certificates shall have a 10- notice of cancellation. 4. Contractor agrees to assume responsibility for compliance with all applicable federal and state laws with regard to health, safety and accident prevention, including, but not limited to, the Federal Construction Safety Act and Occupational Safety and health Act of 1970 and any other rules, regulations and standards relating to the work to be performed by contractor under this contract and the employment of labor, equipment and materials herein. 5. To the fullest extent permitted by law, Contractor will indemnify, defend and hold the Owner harmless from and against all liability, claims, losses, costs, expenses and fees arising out of this project or this Agreement to the extent caused or alleged to have H been caused by any negligent or wrongful acts, errors or omissions of the Contractor, its agents, employees, subcontractors or suppliers. 6. All work to be done in a neat and workmanlike manner. a. Contractor agrees to leave workplace clean and orderly upon completion of both rough and fmish work. All debris will be removed from the premises or as directed by General Contractor. b. Contractor agrees that there will be no smoking on the jobsite, and no cigarette butts will be discarded on the jobsite whether it be on the ground or in any garage area. ADDITIONS: Specifications of work to be performed and contract payment are described by City of Bozeman Bid Specifications and piping layout (attached), which by reference becomes part of this contract. Price increases can be effective only with an approved written change order by from Contactor to Owners representative. Two year maintenance agreement attached will be billed in full and the Owner will pay this upon invoicing, which by reference becomes part of this contract. Five year extended warranty attached will be billed in full at the time the UV unit arrives at Contractor's office, which by reference becomes part of this contract. Contractor will work with Director on scheduling of the closing of the pool for one full day to complete work. Contractor will give Director a minimum of two week notice to advertise the closing times prior to the dates agreed upon for installation. Siemens requires 6 -8 week lead time from order to receive date for their UV System. PAYMENTS: Contractor will bill for the UV unit when it is received at Contractor's office. The Owner will pay in full for the UV unit and 5 year extended warranty upon invoicing. Contractor will bill the remaining amounts of the contract when work is done and Owner training is completed. MEETING DATE: January 19 20 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign the award of bid to Watco Pools for construction of the Ultra- Violet disinfection system at the Bozeman Swim Center for $50,863.54. Equipment and Installation $40,983.54 Extended warranty $5,000.00 2 year maintenance contract $4,880.00 Total $50,863.54 BACKGROUND: An Ultra Violet filtration system uses certain light waves of light to kill off bacteria and viruses. The pool water is run through a chamber in which the water is exposed to the light waves. At a certain level of light intensity, and at an appropriate flow rate of the water, the exposure time of the water in the unit will kill off the water born vectors. The Ultra Violet (UV) filtration system is used in indoor swimming pools to accomplish two purposes. The first is to increase the amount of disinfection of the water without having to increase the amount of chemicals in the pool. This disinfection has been very effective against viruses and bacterial out breaks. Neither has been experience at the Swim Center, so this system is a proactive approach that will bring our pool up to the current treatment practices. The second benefit of a UV system is to address the build -up of chloramines in the pool. Chlorine gas is added to the water to purify the water, similar to the practices at the water treatment plant. Chlorine is a highly reactive element and will bond readily with other materials resulting in the accumulation of Chloramines. Chloramine levels at the Swim Center have reached levels higher than the Montana Health Code allows. The UV system will also break down these chloramines. The public will notice this by not being able to smell the chlorine in the air. The elimination of chloramines will allow a reduction in the amount of chlorine used to provide disinfection because more has to be added to overcome the accumulation of chloramines. 41 CITY OF BOZEMAN, MONTANA INVITATION TO BID Swim Center Ultraviolet Disinfection System Separate sealed bids for construction of Swim Center Ultraviolet Disinfection System will be received by the City of Bozeman at the office of City Clerk, City Hall, Suite 102, 121 North Rouse, Bozeman, MT 59715 until 2 p.m. local time on Tuesday, December 15, 2009, and then publicly opened and read aloud in the Gallatin Room located at City Hall. Mailed bids must be received before 2 p.m., Tuesday, December 15. Mailed bids should be sent to: City Clerk, City of Bozeman, P.O. Box 1230, Bozeman, MT 59771. No faxed or electronic bids will be accepted. Mandatory Pre Bid Conference A mandatory pre -bid conference shall be scheduled for December 2, 2009 at 2 p.m. CONTRACTOR(s) and any of the CONTRACTOR's subcontractors bidding on this project will be required to obtain registration with the Montana Department of Labor and Industry (DLI). Forms for registration are available from the Department of Labor and Industry, P.O. Box 8011, 1805 Prospect, Helena, Montana 59604 -8011. Information on registration can be obtained by calling 1- 406 444 -7734. CONTRACTOR's are required to have registered with the DLI prior to bidding on this project CITY OF BOZEMAN IS REQUESTING PROPOSALS FOR THE FOLLOWING: Equipment and installation of an Ultraviolet Disinfection System, including all sub- contracting and project oversight, and maintenance agreement for the Ultraviolet Disinfection System for the Bozeman Swim Center aquatic facility. Ultraviolet water treatment unit shall be a full flow thru unit with an automatic wiper system, NSF approved. The pools designed flow rate is average 1100, needs to handle 1300 gallons per minute. Include a by- pass line for servicing the unit without shutting down the entire pool filtration system. The ultraviolet unit and control panel shall be installed in the filter room. Piping shall run from the main return line of the pool, after the filter, before chemical injection. 43 1. Clearance should be given for the removal and replacement of the lamps and quartz thimbles; a suitable allowance would be 1,25 X overall chamber diameter. 2. A control vale is fitted and is always positioned at the outlet port to ensure a permanently full situation to be maintained and thus preventing untreated water from passing through the system. 3. To avoid overheating, the chamber should be positioned to ensure a permanently full situation. Additionally, a signal from a flow- switch will make sure the UV lamp is on only when water is flowing. 4. Ultraviolet intensity monitor with built -in alarm system to notify operator when output level drops below required level of 60 mj /cm2 (or operator set dosing levels). 5. Ultraviolet temperature control system shall be provided to maintain system integrity in the event of flow interruptions to the chamber. 6. Ultraviolet chamber shall come complete with annealed quartz sleeve with "0" ring seals for water tightness. 7. Chambers shall be complete with ANSI flanges and all ports or vents shall be threaded NPT. The Ultraviolet chamber must be capable of installation in the system so that it remains full under all conditions. 8. The ultraviolet unit must be complete with appropriate brackets or feet for ease of installation. 9. The chamber should be mounted to assure the lamps are parallel to the horizon. D. Ultraviolet Lamp 1. Ultraviolet lamp shall be medium pressure high intensity. Lamp shall be designed to emit continuous Ultraviolet wavelengths in the range of 200nm to 400nm.
