Reason for change:
Removal of City's dirt stockpile to construct stormwater detention pond (CP #09: $1,306.80)
Removal of fencing and placement of temporary fencing to accommodate storm drain construction. This
portion of the fence was mis- located on site plan. (CP #10: $1,334.03)
The gas line running through the property was not as deep as anticipated, and the storm drain had to be
modified at the intersection and a manhole added. (CP #11: $2,083.77)

Question Date Required: 12/1/2009
On drawing C1.0, the east property line fence is shown running on the property line on the east.side of the Police Impound Lot, but
this is not the case. The fence actually jogs and is about two feet off the property line when it•reaches the North East corner of the
Impound Lot. The issue is that the new sewer line runs about 18" of the existing fence and is about 3.5 feet deep which will
undermine the fence and cause it to collapse. Approximately 200 feet of fence to the east of the.impound lot will need to come down
during construction of the sewer line. Does the Owner want a fencing contractor to directly do this work to reinstall the fence or have
BNB do It at our cost plus rates? Also, should the fence be reinstalled at its original location or on the propert line as the existing
plans show?
*Approximately -31- 25' of fence section has been removed so She can continue work without delays.
Answer
The Owner has Indicated that BN can remove the fence during construction. The existing fence material may be used as a
temporary fence at BN's discretion for site security and to maintain a horse fence for the adjoining property. The City will install
a permanent fence at a future date, or make arrangements for the work to be done.

COMMISSION RESOLUTION NO. 4239
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH BN BUILDERS, BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 5th day of October 2009, authorize award of the bid
for the Construction of the Vehicle Maintenance Building and HRDC Bus Barn to BN Builders, Bozeman,
Montana; and
WHEREAS, Section 7 -5 -4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and /or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and /or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and /or alterations to the contract between the City of Bozeman, a
municipal corporation, and BN Builders, Bozeman, Montana, as contained in Change Order #3, attached
hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to
execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed
to attest such signature.
