North 7th Ave. Lighting, ROW, and Preliminary Design.

RECOMMENDATION: The Commission to make a motion to adopt.
BACKGROUND: On April 2, 2009 the North Seventh Urban Renewal Board (NSURB)
motioned and voted to approve the proposed professional services agreement with Allied
Engineering for the Lighting Right of Way Investigation, and Preliminary Design for North 7th
Avenue. This contract was for $73,579 and included provisions for site evaluation, lighting
studies, project and funding identification, and corridor character development.
On September 14, 2009 NSURB submitted a request to the City Commission for funds
allocated by House Bill 645 be directed to make significant improvements to pedestrian safety
and connectivity along N. 7th Avenue. The bulk of the proposal included infill of sidewalk along
the East side of North 7 Avenue in areas where sidewalk is missing. The City Commission
motioned and voted to grant $110,400 to the board for their proposal.
At the time of the City Commission granting funds for sidewalk infill along North 7th
Avenue Allied Engineering was still under contract, and even drafted the request for funds to the
City Commission. On December 3, 2009 NSURB motioned and voted to have staff amend the
original professional services agreement with Allied Engineering to include the design and
specifications for the sidewalk infill on the East side of North 7 Avenue. Amendment Number
1 to the professional services agreement is for $44,916 and includes provisions for drafting and
securing the necessary easements, design, drafting of the construction documents, and bidding
the project.
City staff and NSURB has attempted to keep the contract price to a minimum by assisting
in drafting and securing the necessary easements, doing all contract administration in- house, and
also doing all construction inspection in- house.
Several factors contributed to the necessity of having Allied Engineering do this work.
Two major factors worth mentioning are 1.) Allied Engineering had already investigated the
corridor and was familiar with what NSURB and the City Commission wanted done. For staff to
pick up the project and see it through design, bid, and construction would have put major time
crunches on a project that must be constructed by the end of the summer. 2.) The proposed
amendment to the professional services agreement requires surveying and some design work for
a landscape architect. These types of work are not able to be done in- house.
FISCAL EFFECTS: The contract will be paid out of the NSURB Big Box Funds. The
bulk of the construction costs of the sidewalks will be paid out of the House Bill 645 funds
granted to NSURB from the City Commission. Any cost over -runs will be paid out of the
NSURB Big Box Funds.
ALTERNATIVES: As suggested by the City Commission.

Amendment No. 1 to Professional Services Agreement
For North 7th Ave Lighting, ROW, and Preliminary Design
THIS AGREEMENT is made as of this ca�o9 l day of cilov m-- 2010, between
THE CITY OF BOZEMAN, a Municipal Corporation, Bozeman, Montana, erein referred to as OWNER
and ALLIED ENGINEERING SERVICES INC., an Engineering Consulting Firm of Bozeman, Montana,
herein referred to as ENGINEER.
WHEREAS, the parties have entered into a Professional Services Agreement dated July 8, 2009, herein
referred to as Original Agreement for professional engineering services; and
WHEREAS, the parties desire to further amend the provisions of this Agreement.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED
HEREIN, the parties agree as follows:
1. EXHIBIT B Modified Scope of Services will replace EXHIBIT A Scope of Services for the
remainder of the project as of 2010.
2. ARTICLE 4 of the original agreement relating to professional engineering services is amended
to include the following additional services:
4.6 Sidewalk Infill Allied Engineering will design approximately 810 lineal feet of
sidewalk infill on North 7 Avenue from Durston Road to Oak Street. Approximately
515 lineal feet of infill sidewalk design is located on the east side of North 7 Avenue
in three separate locations (near Big 0 Tire, Vans, and Speedy Glass). Approximately
295 lineal feet of infill sidewalk design is located on the west side of North 7 Avenue
near the northwest corner of its intersection with Oak Street.
4.6.1 Project Management Engineer will coordinate with the Owner, perform
internal correspondence /administration, and attend the monthly NSURB
meetings.
4.6.2 Easement Exhibits Engineer will perform courthouse research, produce
six easement exhibits, and assist with property owner negotiations.
4.6.3 Design Engineer will perform a site reconnaissance with a representative
from the City Engineering Department. Engineer will perform up to 8 man
hours of additional topographic survey as needed. Engineer will design
approximately 810 lineal feet of infill sidewalk. Engineer will design curb
adjustments at Vans to accommodate a bus shelter pull -out. Engineer will
design sidewalk intersection improvements at the northeast corner of North
7 Avenue and Tamarack Street and at the northwest corner of North 7th
Avenue and Oak. Engineer will design eight pedestrian ramps to
accomplish grade changes at the end of proposed sidewalks. Engineer will
design lighting infrastructure to accompany the sidewalk improvements to
allow for future installation of street lights. Engineer will design
landscaping. Engineer will design landscaping infrastructure (conduit

stubs) to allow the future installation of sprinklers.
4.6.4 Construction Documents Engineer will prepare plans at the following
completion levels: 60 90 and final. Engineer will prepare
specifications at the 90% and final completion levels. Engineer will prepare
both a preliminary and a final opinion of probable construction cost
estimate.
4.6.5 Bidding Engineer will prepare draft and final bid documents. Engineer
will assist with advertising the bid. Engineer will assist the Owner with
conducting the pre -bid meeting. Engineer will issue any necessary
addendums. Engineer will tabulate bids and assist the Owner with awarding
the bid.

3. 60% Plan Set (11x17 format): two hard copies and an electronic copy
(pdf).
4. 90% Plan Set (11x17 format): two hard copies and an electronic copy
(pdf).
5. Final Plan Set (11x17 format): two hard copies and an electronic copy
(pdf).
6. 90% Specifications: two hard copies and an electronic copy (pdf).
7. Final Specifications: two hard copies and an electronic copy (pdf).
8. Preliminary Cost Estimate: electronic copy (pdf).
9. Final Cost Estimate: electronic copy (pdf).
10. Draft Bid Documents: two hard copies and an electronic copy (pdf).
11. Final Bid Documents: two hard copies and an electronic copy (pdf).

3. ARTICLE 6.1.1 of the original agreement relating to compensation for Engineering Service is
amended to read:
"Payment. The OWNER shall for design phase services performed as Basic Engineering
Services under sections 4.1 through 4.6 of this agreement pay a total sum in the amount of
118,495.00 for such services."
4. ARTICLE 6.1.2 of the original agreement relating to Payment Schedule is amended to read:
Payment Schedule. Total cumulative payments for the design phase engineering services
for sections 4.1 through 4.6 shall not exceed the following ceilings:
36,789.50 (31% of design fee) until the deliverables for scope items listed under
section 4.1 Site Evaluation has been submitted to the OWNER.
66,221.10 (56% of design fee) until the deliverables for scope items listed under sections
4.2, 4.3, and 4.4 have been submitted to the OWNER and review authorities.
73,579.00 (62% of design fee) until all deliverables for scope items listed under Sections

4.1 through 4.5 have been submitted to the Owner and review authorities.
92,000 (78% of design fee) until the Final Easement Exhibits deliverable listed under
section 4.6 is submitted to the Owner and review authorities.
106,648 (90% of design fee) until the 90% Completion Level Plans and Specifications
deliverables listed under section 4.6 are submitted to the Owner and review authorities.
Except as specifically amended herein, the original agreement shall remain in full
Parties shall be bound by all terms and conditions therein.
IN WITNESS WHEREOF, the parties hereto do make and execute this Agreement
above written.
