Kukulski, City Manager SUBJECT: Re-appointment to the Board of Appeals MEETING DATE: March 01, 2010 MEETING TYPE: Action RECOMMENDATION: Re-appoint one member to the Board of Appeals. BACKGROUND: On December 31, 2009 one term on the Board of Appeals expired. There is also one ongoing vacancy. The member with a term expiration has re-applied; no other applications have been received. Appeal rules for this Board include a provision that an appellant can request that an appeal be postponed until a full board is seated. Currently, there is an appeal awaiting the appointment of a fifth member. The Board of Appeals was established under Commission Resolution No. 2483, adopted October 3, 1983 to determine the suitability of alternate materials and methods of construction and to provide reasonable interpretation of the following codes of the City of Bozeman: Building Code, Electrical Code, Mechanical Code, and Plumbing Code. The Board of Appeals shall consist of five members appointed by the City Commission and serving without compensation, who are qualified by experience and training to pass upon matters pertaining to building construction. The Building Official shall be an ex officio member and shall act as Secretary of the Board. The initial terms of office were as follows: one appointed for one year, two appointed for two years, and two appointed for three years. Succeeding appointments are for a period of three years. This board has one ongoing vacancy and a recent expired term with one re-applying applicant. Applicant seeking re-appointment Gene Brooks ALTERNATIVES: As suggested by the City Commission.
