Kukulski, City Manager SUBJECT: Jurisdiction of F&H Building Conditional Use Permit/Certificate of Appropriateness Application (#Z-10008) Final Approval MEETING DATE: February 16, 2010 AGENDA ITEM TYPE: Consent Item RECOMMENDATION: That the City Commission consider reclaiming to itself the final approval of the F&H Building Conditional Use Permit/Certificate of Appropriateness application, per Section 18.64.010 C.1 of the B.M.C., and further set a tentative public hearing date of March 8, 2010 for formal consideration of the application proposal. BACKGROUND: The F&H Building Conditional Use Permit/Certificate of Appropriateness (CUP/COA) application includes the rebuilding of the Rocking R Bar business which was destroyed in the March 5, 2009 downtown Bozeman explosion. The application includes the previous Rocking R Bar property (which also included Boodles and Pickle Barrel restaurants) and additionally includes the previous Montana Trails Gallery property. The CUP is required because the sale of alcohol for on- premise consumption is proposed for establishment on the additional property. The application was submitted to the Department of Planning & Community Development on January 27, 2010 and deemed acceptable for initial review on January 28, 2010. The CUP/COA application is normally subject to the approval of the Board of Adjustment. However, the application proposal will likely be connected with a City of Bozeman project using the appropriated federal money through the Department of Transportation and Housing and Urban Development for the “reconstruction following an explosion in a downtown historic district.” The City Commission will be a part of that project review and City Staff believes it is in the best interest of the community if they also review the CUP/COA application. The City Commission public hearing date is tentatively set for March 8, 2010. UNRESOLVED ISSUES: None identified. FISCAL IMPACTS: The standard application fee was received for the CUP/COA project and was added to the Department of Planning’s application fee revenue.
