COMMISSION RESOLUTION NO. 4232
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION /MODIFICATION OF CONTRACT
WITH BN BUILDERS, BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 27th day of May, 2009, authorize award of the bid for
the Construction of the Landfill Addition to BN Builders, Bozeman, Montana; and
WHEREAS, Section 7 -5 -4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and /or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and /or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and /or alterations to the contract between the City of Bozeman, a
municipal corporation, and BN Builders, Bozeman, Montana, as contained in Change Order #5, attached
hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to
execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed
to attest such signature.

The Contract is changed as follows:
Increase Contract Sum.
Reason for change:
Owner and Architect discussed need for heat tape at eave/ gutter. An electrical outlet had initially been installed
for heat tape, and it was agreed to wait until winter conditions to asses the extent of heat tape that would be
necessary. After viewing ice damming, heat tape at the gutter was considered necessary, but not on the eave
itself.
French drains at the downspouts were discussed by Owner and Architect as insurance that the heated runoff
coming from the downspout would not immediately freeze in the shallow gravel and create an ice patch that
extended to the sidewalk. CP #5014 is the contractor's bid for work.

The original Contract Sum was 271,648.00
The net change by previously authorized Change Orders 33,532.09
The Contract Sum prior to this Change Order was 305,180.09

Contract Time Adjustment:
The Contract Time will be increased by zero 0 days.
The date of Substantial Completion as of the date of this Change Order therefore is: September 28, 2009

CONDITIONS
It Is understood and agreed that we shall not be liable for any loss, damage, or delays occasioned by tire, strikes, or material stolen after delivery
upon premises, lockouts, acts of (god, public enemy, accidents, boycotts, material shortage, disturbed labor conditions, delayed delivery of
material from seller's suppliers, force majeure, inclement weather, floods, trelght embargoes, causes incidental to national emergencies, war,
or other causes beyond the reasonable control of the seller, whether of like or different character, or other causes beyond his control. Prices
quoted in this contract are based upon present prices and upon the condition of the proposal being accepted within thirty days. Also general
conditions which are standard for specialty contractors in the constructlun Industry,
In the event of significant delay or price Increase of material occurring during the performance of the contract through no tault of the contractor,
the contract sum, time of performance, or contract requirements shall be equitably adjusted by change order in accordance with the procedures
of the contract documents. A change in price of an item of material shall be considered significant when the price of an item is between
the date of this contract and the date of installation.
