SUBJECT: Approval of Change Order #3 for the Lower Yard Vehicle Maintenance
and HRDC Bus Barn for added site work.

RECOMMENDATION: Authorize the City Manager to sign Change Order #3 for the City’s
share of the cost of the added site work for the Lower Yard and Vehicle Maintenance and HRDC
Bus Barn in the amount of $2,362.30.
BACKGROUND: Site work continues on the lower yard with most of the utility service lines
laid in. The contractor is still working with the building manufacturer on the final configuration
of the building so that plans can be submitted to the Building Department for review and the
final foundation details can be developed.
This change order is for three site related modifications that had to take place in order to
accommodate on site issues that were identified during various phases of excavation. The plans
call for a stormwater detention pond on the far north end of the property. Between the time that
the site survey was completed and construction on this project began, the sand storage shed was
constructed in the same general area as the detention pond. The surplus soil from the excavation
of the sand storage building was bermed around the building to minimize any run-off. The
contractor incurred added expense for added excavation and reconfiguration of the berm to
accommodate the detention pond. The cost for this change is $1,306.80. It was brought to the
attention of the contractor that if the problem had been called out then the city crews could have
moved some of the soil. In response the contractor has agreed to notify the city first if similar
situations arise and will cover a portion of this cost.
The plans call for the installation of a storm sewer line along the east boundary of the property.
In order to achieve the proper fall for the line an additional service manhole had to be installed to
get around a gas line on site. The existing fence line is inside the property boundary and the far
northeast corner of one of the gate posts was in the way of the line and needed to be relocated.
The fence was removed along the line and a temporary fence was put in place to secure the site
during the term of construction. Cost for the removal and reinstall was $1,334.03.
In order to avoid the on-site gas line and to maintain the proper slope for the sewer line a
manhole was installed. Cost for the added excavation and manhole was $2,083.77

Total cost of this Change Order is $4,724.60. These changes are site related costs which means a
50%/50% split with HRDC. HRDC has approved this change as per the requirements of the
Memorandum of Understanding.
FISCAL EFFECTS: The total cost to the City for this Change Order is $2,362.30. This
project cost will be paid out of the project contingency.

Contingency Balance $121,299.58
ALTERNATIVES: As suggested by the City Commission.

COMMISSION RESOLUTION NO. 4239
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH BN BUILDERS, BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 5th day of October 2009, authorize award of the bid
for the Construction of the Vehicle Maintenance Building and HRDC Bus Barn to BN Builders, Bozeman,
Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and BN Builders, Bozeman, Montana, as contained in Change Order #3, attached
hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to
execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed
to attest such signature.

PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular
