RECOMMENDATION: Continue to discuss the process for appointing a person to fill an Office of Bozeman City Commissioner left vacant by the recent resignation of Eric Bryson, accept candidate presentations and public comment, and, if Commission desires, make the appointment followed by a swearing in and seating of the new Commissioner. BACKGROUND: On January 19, 2010 the Commission had discussions regarding the process for appointing a person to fill the office of city commissioner left vacant by the resignation of Eric Bryson. The Bozeman Charter and state law require you to make an appointment to fill the remainder of the term (until the first meeting in January, 2012). During the discussion on January 19th you solicited comment from the public and several candidates on a process for making the appointment. At the end of that discussion the following motion was made and adopted by a 4-0 vote: It was moved by Cr. Mehl, seconded by Cr. Becker that when the city commission meets on January 25, 2010 we invite all candidates who are interested to speak, to state their case for why they should be commissioner, followed by public comment then discussion by commissioners, then votes by commission to narrow and finally select a candidate. A friendly amendment was made to limit each candidate to five minutes. The motion passed 4-0. The Commission may or may not make the decision regarding the appointment during the January 25, 2010 meeting. If a decision is not reached, this item will be discussed again during the February 1st meeting again with the possibility of making the appointment. If need be, a third discussion could take place during the February 8, 2010 meeting. Once a decision is reached, the Commission would likely move forward with the swearing in ceremony directly after. 77 FISCAL EFFECTS: None. ALTERNATIVES: As suggested by the City Commission.
