SUBJECT: Approval of Change Order #2 for the Lower Yard Vehicle Maintenance
and HRDC Bus Barn for asbestos remediation

RECOMMENDATION: Authorize the City Manager to sign Change Order #2 for the City’s
share of the cost for the asbestos remediation for the Lower Yard Vehicle Maintenance and
HRDC Bus Barn in the amount of $3,294.32.
BACKGROUND: The contractor for the Lower Yard Vehicle Maintenance and HRDC Bus
Barn facility project was given notice to proceed on November 4, 2009. Mobilization, site work,
excavation, and utility connection work is under way. The site is the location of the city’s old
waste water treatment plant. When the site was abandoned a good portion of the infrastructure
was left in the ground from the old plant.
As part of the civil engineering design work some test holes were dug on the site to verify the
location of the old facility components and to document the soil conditions on site. One of the
old clarifier tanks was abandoned on site. This tank, a large concrete vat, is partially under the
building footprint. In order to get the proper compaction under the building, the soil in the
clarifier had to be removed and replaced with engineered fill material. During initial excavation
of the tank some asbestos containing material was uncovered.
Old aerial photographs of the plant show some sort of caretaker’s house on the site. When the
site was abandoned, this building was torn down and the pieces thrown into the clarifier. The
siding materials from the building were the hard transite shingles.
Today, the proper disposal standards for these materials requires double bagging and disposal at
a licensed landfill. Because we did not know the full extent of the material buried in the ground,
a time and materials agreement was developed with the contractor to take care of the removal
and disposal. The estimated amount for the removal and disposal was $10,000 to $12,000.
As per the memorandum of understanding with HRDC they also agreed to sign off on the
agreement and participate in a 50 / 50 split of the cost.

The work was completed and a certificate of clearance was received from the state on Montana.
The cost of removal was $6,588.64, split 50/50. In order to avoid a mark-up on the disposal cost,
the landfill charges were paid directly by the city. The Logan landfill was paid $3,091.00 for
costs of disposal. One half of this amount will be paid for by HRDC.
FISCAL EFFECTS: The total cost to the City for this change order is $4,839.82. This
project cost will be paid out of the project contingency. The joint cost for the City and HRDC of
$9,679.64 is well below the estimated cost of $10,000 to $12,000.

COMMISSION RESOLUTION NO. 4233
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH BN BUILDERS, BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 5th day of October 2009, authorize award of the bid
for the Construction of the Vehicle Maintenance Building and HRDC Bus Barn to BN Builders, Bozeman,
Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and BN Builders, Bozeman, Montana, as contained in Change Order #2, attached
hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to
execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed
to attest such signature.
